HELP!

I wish had found this site earlier. I was foolish enough to get myself in this trouble and on top of that I contacted PDL Assistance and got talked into using their services. UGH! I am currently trying to get my money back from them.

Here is my problem. I have a ton of loans and after doing some research this morning I think many of these companies are doing business illegally in AZ.

I have sent out the request to stop the ACH transactions, although none of them have stopped and now my checking account is so overdrawn with fees I don't know how I will ever pay it off. My bank has been a nightmare. They will only offer to do stop payments and are refusing to put a hold on my account while I sort all of this out.

Any advice will be appreciated.

i would speak to a bank manager and move up to corporate if you have to. they can do this, stopping payments will not work as they will simply go under a different name and take money out anyway.
i do not know the state laws of AZ but am pretty sure geneva roth is illegal everywhere - not positive though. that is the only company listed i have had experience with. how much did you pay each company?

Unfortunately I have spoken to the banks corporate office who told me that since I have done business with these companies in the past there is nothing I can do except provide the bank with proof that I notified the companies that I had revoked the ACH and they will file a "claim" to see if they can get our money back.

I am working on figuring out how much I have paid back, I am just having a hard time determining if they are legal or not. I printed a list of licensed lenders in AZ but I know that a lot of them have many names so it is hard for me to tell if they are legal or not.

A think a good handful of them are illegal.

I know one member on here is from AZ and may have delt with these companies.

I will also do some checking.

CashNet USA I know is legal in most states but the rest I am not sure about.

ZIP I think is legal in one state but I don't think there are in AZ.

If you notified them at least three days before the ACH then you gave them notice and can give your bank that information. By Federal law the bank has to honor that.

Can I ask what bank you have?

The bank is Bank of America and I have been dealing with them since March 6 with no satisfaction. In fact, one of their customer service representatives called me stupid and advised me to take my business to another bank.

It looks like CashNet is legal in AZ.

I don't mind dealing with the leagal companies but I would like to sort out the illegal ones so I know who to make repayment plans with.

I thought it might be BOA.

If you have not talked to the branch manager then try that if they won't help then you have to go over the bank manager and go to corporate to get any help. They are horrible at customer service when it comes to PDLs.

I know there are others who have had the same problem with them.

I would report that customer service person.

I will search and see if I can find a thread from last month about a person that had the same issues with BOA and see if I can find what they did to get them to finally shut down the account.

Call their VP immediately at corporate office and report this. You can get the information by googling.

The only one from that list I found on the database was CashNet.

You want to make sure you are looking at the list for deferred presentment companies. When you first click on the license link you will see it over the right.

Hello SuzP I am from AZ as well. When I started reading your thread I knew right away that it was BOA you were dealing with. They are horrible!!!!! When I came to this forum back in October like you I read everything I could to begin the process. I knew my first hurdle would be BOA so I took a different route with them to get my account closed. I dont know where you are located in AZ but find a branch that will help you. If you have to go from branch to branch and tell your story do it until you hit the right person. Also take a copy of your Rights on EFT which I will provide you the link for.

Read the Section on Your Rights on Electronic Payment of Payday Loans

Write the Bank a letter including this information and take it with you then follow the sticky on how to deal with illegal lenders.

Cashnet is legal and licensed to lend in AZ and you should call and work out payment arrangements with them.

Thanks for helping me find out who is legal and who is not.

I will be sending out letters to the illegal companies today.

I will keep trying wit B of A. I have been to all 3 of our local branches and they just seem annoyed that I have come in and keep telling me to call customer service since no account changes can be made at the branch level.

You should be fine if they opened the account for you. I am sure at this point BofA has not reported you to Chex System which is usually why another Bank will not open an account. BofA will send you a notice stating their intentions to report you to Chex System if you do not clear your account with them and they will eventually close it but that will not stop what is happening now. You need to take that letter to them asap and call their corporate office for help. You need to make sure they understand that you are dealing with unlicensed illegal lenders. You need to fax or send the information I provided you to their corporate office or like I said go to your branch and provide them with the information and make them contact someone else for you. I hate to say this but you need to be agressive, I myself hate confrontations but you need to do everything you can at this point to protect your interests.

I can not close the account because it is overdrawn. Which, I understand but after talking with all of you I now know that it is overdrawn due to illegal pdls.
I faxed and emailed all of the companies I have contact information for this morning with the letter I found on the site to the illegal pdls stating that I knew they were illegal and they could only contact me through mail or email and I am reporting them.
I will start working on the complaint paperwork tonight.

I keep feeling like there is more I can do, is there?

I am going to get my budget together this weekend and call the legit pdl and make payment arrangements.

That is typical behavior from these companies. They will try to collect as soon as they realize you have blocked their ACH authorization.

The calls can be annoying, but they are expected to be nonstop for awhile. I suggest you tell them to communicate with you by USPS or email only. They will get the picture sooner or later.

Did you pay them the amount borrowed?

Is so then respond that they loan they issued was unlicensed/illegal and you have paid the loan in full according to the laws of your state.

If you have not paid it all then respond the same but that you only owe X amount of dollars to make full pay payment.

I got a couple of calls today while I was working. One of them was legit and now I can not get a hold of them. I'm not worried about the illegal pdls but I want to make everything right with the legal one.
Any idea how long will they give me to respond?

I'm also looking for anyone else who has had to get money back from PDL Assistance.

I am ready to write a letter to them to get my money back and I am curious how much anyone else was able to get back.

I can not get United Cash Loans to stop calling me. I have faxed and emailed the letter stating that I think they are illegal. Now they want me to send them a letter that must be notarized and they will send all information via fax. They are refusing to do anything through USPS or email.

On the bright side, the legal PDLs have been great in setting up payment arrangements. It is still going to be a huge financial stress for the next two months but I am seeing light at the end of the tunnel.
