Ok, just starting out so here goes - may not remember everything.

USFastCash - owe $100 - two more payments
PayDayMax - owe $100 - two more payments
NAtionwideCash - owe $250 - paid $250
DJR - owe $200 - paid $480
EPP - owe $200 - paid $480
JetLending - owe $200 - paid $120
WebPayday - owe $200 - paid $180
High Country - $350 - will start paying back on 5/15 at $105 - already paid one off to the tune of $975 on a $300

pdl's are prohibited in NC.that means every place is illegal.if you could try to find bank statements that show how much was borrowed from each.you only owe the principle borrowed nothing more.every supposed debit for fees goes toward the loan.there is a sticky.third from the top of this forum that informs you of how to deal with illegal lenders.

I have been reading on here for the past few hours and now feel quite empowered to deal with these people - and I use the term loosely! I have gotten a sample of the rescinding letter and read the stuff about closing my bank acct. I think that is what I am going to do Monday. It is too late for this pay day, but not for anymore.

Well, I went yesterday to my bank and they were great! They closed my account and opened another one for me. I asked many questions about if the ACH's would poop the other one open again and if they would transfer to the new account. I was reassured that those scenarios would not happen, as it was monitored at my local branch. I then went to my HR office and got my direct deposit changed and made them aware of the situation. They were great, too.

I have emailed or faxed all the companies and am now waiting on responses. How long does it usually take to get something back? I am curious to see what happens next!

some might e-mail you.some might call you.it depends on how much was actually debited for each pdl.i do know that US FAST CASH thinks they are above the law and will fight you on there legality.whatever you do.do not believe a thing they say or threaten.being as they are illegal they can't do a thing to you.

I respect a consumer who researches the services to which he/she uses. With that being said when you applied for and agreed to the terms of the loan it would have behooved you to read the complete contract you were agreeing to. You are a citizen of the state of North Carolina, however the contract was not made in the state of North Carolina. The contract was completed via the world wide web, the governing law (clearly outlined in your contract) which you agreed to by your legal e-signature is based in the isle and providence of Delaware. When you spoke with Francina on 4/01/2009 at 10:38am CST, she clearly outlined how the loan works and what the finance charges were, yet you still accepted the loan.

With all the information at hand I am still willing to work out arrangements for the principal that is still owed on your account. We will cease debiting the finance charges of $60, however the account will not be marked ???Paid In Full??? until the principal amount of $200.00 has been satisfied. You may contact our offices 8am-5:00pm CST Monday-Friday. Our toll free phone # is 1-877-844-5798. You must contact our Customer Service Department as soon as possible. If no contact is made within a reasonable time the account will be sent to a third party collection agency.

that is there form letter.i bet you can tell by the fact they don't know your female.just keep resending your letter.they will get the hint.also try to enclose a copy of your state laws.do not call them.they will only stupidly threaten you.you don't need that.

I figured it was a form letter. I told them the arrangements I was willing to make to pay the balance due, which is $80. But I didn't want to call them and get back into that.

North Carolina has a statute on the books that says that no state court can enforce a judgment from another jurisdiction in favor of a lender that is not authorized to do business in North Carolina. This means they could - theoretically - sue you in their own state or country (most won't) and get a judgment. But other than impacting your credit report they can't do anything more with it, since no North Carolina court will allow them to garnish wages or seize assets to satisfy the judgment.

I have stated that I would not do telephone negotiating as I need everything in writing as per instructions from the NC Attorney General. As this is an illegal loan in the state of NC and has been been paid off and has an overpayment of $340, I do not see where there is anything to review. I request a paid in full letter and a refund of the $340 overpayment.

Thank you for your response re: my loan. Please note that this loan is illegal in the state of NC and I am not obligated legally to pay you anything. I have had two loans through PDL/High Country/RBT and have proof through my bank statements of these loans and the amounts repaid. I will not settle for anything less than a Paid in Full letter on the open loan I have now and am also requesting a refund in the amount stated in my letter to you. Any type of collections action brought against me is also illegal as this loan is ILLEGAL in NC, unless you can produce a license showing me otherwise. You will not receive any more payments from me, as the loan you are referring to as paid was only for $300 and since this loan was illegal any payments made above the principle amount should be applied to the second loan for $350. That leaves a balance of $225 due me.

Please let me know when I can expect the Paid in Full letter and the refund check in the mail.

Yep. Closed my account Monday the 4th and sent the letters by fax and email the next day. I also resent everything yesterday and will continue resending them until I get my paid in full letters and hopefully, some refunds! One of the ones that I still owed on the balance accepted my agreement to pay it off next month and haven't heard from the other one that I still owe on the principal.

Why are you ppl always trying to communicate with the PDLs only by mail????
Send your C&D letter and the next day call and ask what is the situation of your account. Trust me...it works! You gotta push these ppl, send them faxes, e-mails etc. But you also have to call them!
Where's the harm in actually talking to them?

We have received and reviewed your correspondence regarding your complaint with DJR Group, LLC.

While the information that you have collected may apply to companies that have physical locations in your state, it is our opinion that it does not apply to our internet business model. This is based on sound advice from our legal department.

The money was lent to you in good faith with the understanding that you would abide by the terms detailed in your loan contract. We upheld our end of the agreement by crediting the funds to your account in a timely manner. The Loan Note and Disclosure that you e-signed and thereby agreed to is very detailed and clear so as not to cause any confusion to the borrower, and meets all the Truth-In-Lending and Reg Z requirements as prescribed by Federal statute.

Upon review of your account history, you clearly knew all terms and conditions of your loan. We have all the legal contracts you signed, in which you agreed to terms and conditions of the loan.

In the interest of compromise, your account has been marked as ???Paid in Full??? and there will be no further attempts to collect on this account. There will be no refund on your account and no further loans will be offered to you.

Found out from my bank this morning that 3 of my former PDL's tried to go thru my old account on Friday - and one of those I have a PIF from! Go figure! I have 5 that I have not received any response from - and two of those tried to debit my old account. And one of those sent me an email saying I qualified for another loan! I am going to resend all my letters again today (third time) requesting a response. I am not stopping until I get PIF's from all of them!

USFastCash and PayDayMax have blocked access to my online account information, so I know they have gotten my letters, though I have not heard anything back from them. DJR sent me a PIF last week, and still tried to debit my old account Friday. Nationwide and WebPayDay also tried to debit my account. I talked to my bank today about reversing some of the past ACH transactions and we are working on it. They can only go back so far, and I am only doing it with those companies that I have overpaid by an extremely large amount and that have not replied at all to my letters. At least it is something! Resending all the remaining companies letters today and will continue to do so until I get a PIF from them or hear anything. I still haven't gotten any phone calls, and the solicitation emails stopped for a couple of weeks but now my junk folder is full of them again, so I think I must have had most of my accounts marked PIF though I haven't gotten them. I can only hope!

Received my first nasty, threatening call today from Nationwide Cash. They called regarding the notice that my account was closed. I took out two loans with them in the total amount of $500 - paid back $725 on the first one alone. Blake at Nationwide threatened to send a local affiliate to my office today re: the amount owed. He said that they had not received my letter that I had faxed over three times and when I asked him for a fax number to use, he refused to give me another one. He kept trying to tell me that they were legal in DE and therefore they could take action here and I said no they couldn't, etc. I am going to fax the letter again and put it to his attention. And see what happens - need some encouragement - they are scary on the phone!

The call came at work and most of the time I don't even look at the caller id, just answer it. They caught me unaware this time, but not again! It was a scary call - they get really mean and he kept saying they will pursue action as I seem to have my plan already in place. I told him there wasn't anything they could do as the loan was illegal here. I guess he didn't like the fact that I had an answer for everything, thanks to this place!

Have filed a complaint with the NC DOJ re: Nationwide Cash. The person I spoke with said that all payday loans are illegal in NC and they cannot do anything to collect from me. The DOJ will send them a letter telling them to cease and desist from all actions against me, including telephone calls, letters, threats, etc. They definitely backed up all the information I got off here.

Well, Nationwide debited my new account for $250 this week, but my bank reversed it after I told them that I had not given them any authorization to debit from the new account. Nationwide has been trying to call me and threaten me at work and on my cell. I faxed over another copy of my revocation & C&D letter yesterday. WebPayDay has been calling too, so they also got another copy. I have asked WebPayDay for their address to mail a MO to for the remaining balance, but they refused to give it to me the one time I inadvertently talked to them. Both companies have been nasty and threatening. Nationwide tried calling from two different numbers but as soon as I hear Nationwide, I hang up. The same with WebPayDay. My home phone number has been changed so they can't call me there. And I am trying to get them blocked from my cell too. The only place they can get me is at work and I have caller ID.

All in all this method of getting rid of the loans has helped and I am thankful for this site and those that are here to help.

All of you guys are a bunch of dishonest pieces of crap. I don't see how you don't see that you are stealing and that all of you are going to rot in Hell. It is people like you that make our economy so bad. I don't see you complaining when these companies give you money to keep your electricity on, or buy food for your families. How quickly people forget and then look to screw over the person or people that helped them out.

BillyWhip - And illegal PDL companies are honest? They don't even bother to get licensed as required by the states where they are trying to do business, give people bogus addresses, and lie constantly. The only economy that is being helped by charging $90 interest on $300 loans is the wallets of the companies themselves.

Wieck2- Honest yes, is it a ripoff?, yes also. But the part that irritates me, is that all of you people that are complaining about these companies are using them. So you agree with the company to pay them back on the terms that they have stated, then after they provide you the money you go back on your word and just try to get out of paying it. That's what the whole problem is with our economy, a whole bunch of people that do not want to take responsibility for their own actions. You wouldn't even be on this site if you were a responsible person in the first place. Oh, I bought a house that I can't afford, I'll try to get the government to bail me out. Oh, I bought a car that I can't afford, I'll just file bankruptcy and make the automaker take a loss on the loan. How about this, live within your means and all of these issues go away.
