I just have to post that these people are hilarious!! The same guy calls leaving me messages- one time he'll say he's from loanpoint, the next time it'll be some "law offices", then he's with loanpoint again etc. Calls from the same #, same guy, gives me the same # to call back. Now he tells me he has some "grivance" thats been filed against me on his desk or something like that which I'm sure is supposed to sound really scary!! LOL

I am email these jokers at least twice a day with C & D which they ignore. 5 business days before my due date I sent an email revoke ACH and telling them my account was closed and asked for an alternate way to send my money in. They responded (in writing) that they were going to continue to debit my account and I would incur additional charges for each returned item! And that the only form of payment they would accept is thru ach debit so I'd better go open up a new checking account!! So I am saving all phone messages and emails and forwarding to the Utah AG and DFI since they supposedly have a license there. They obviouly have no regard for the law.

Today is a dark rainy day and I was getting bogged down with some personal issues when this latest message came and it gave me a needed laugh and got my mind off of the problems and added some lightness to my mood which I definetly needed. LOL I have half a mind to call him up so I can screw with him on the phone but since I said no telephone contact I will have to abide by my own rules.

put in your letter they are illegal and you are entitled to a refund for all amounts paid over the loan - demand that amount of money in your letter. They will settle up with you and you will get a refund. I did.

I am pretty sure they are legal for me, but I will investigate more later. Which is why the whole thing is so funny. I DID request an alternate way to send in my money as my account is closed and they said the only form of payment they accept is thru ACH so that "I better go open up a new checking account" -in writing I have this!

please remember if your state requires a PDL to be licensed within the state then that PDL must abide by your state laws. No matter where they are licensed.

However, there are some states that out of state lending and import their homestate laws an interest into your contract.

What state are you in?

Read the link, thanks. Exactly the position I am in although I have not paid them quite so much money, but I have overpaid. No resolution in the thread though which is what I find with the threads I have found that apply to my situation. Makes me wonder how it all turned out...

Well I had a similair situation with a lender licensed in Utah as well. They were not licensed to lend to VA residents and VA requires in state licensing. So I sent them all the information from my DFI and I was refunded over $300.

Needless to say it took time for all of this, but I stood my ground and in the end it was all worth it.

unfortunately TN is one of the loophole states and they don't have to be licensed here. I am more than willing to send in this little amount I owe them but if the only way they will accept it is thru an ACH on a checking account then I guess they are out of luck. Which thier behavior does strike me as odd if in fact they are licensed, because the other licensed ipdl's I have dealt with honored my ACH revoke, gave me a payment plan and an alternate way to pay.

I have... several times. Offered to pay the principal plus the interest that was due at the time I closed my checking account and revoked ACH(which was 1 week before I was past due) just asked for an alternate way to get it to them and they refused, said the only way they could accept payment was thru ACH. Well...that ain't happening...

go back to my post and send them a letter to that addres - it will work - I got a refund. GRC is illegal pretty much everywhere and they know it.

they are a/k/a as GRC (Geneva Roth Companies) send a letter to Attn: Manager 1338 South Foothill Drive Suite 325 SAlt Lake City, UT 84108

demand refund of any amount you paid over the amount you borrowed. they are illegal and not entitled to anything over what you borrowed. Give them a deadline to re-pay the money or you will proceed with court action - give them 2 days to put the money back in your account or overnight it you. They wil require you to sign a release
