Has anyone heard of James West Attorney from Houston. They have called me for a debt with American Express.

I did a Google search and found that the actual name of the law firm is West & Costello, LLC. If they are calling you up for a debt with American Express, they are required to send you a written notice within 5 days of initial communication, informing you of the amount of debt, the name of the creditor and a debt validation notice.

No, I think they are based out of Houston, texas. The other thing is that they do not have my present address as I am out of the country and i dont think they have my forwarding Address. I would love to repay the debt but I do not have the funds or resource to do it at the Moment. What can they do if they cant find me.

The law firm has been leaving messages for me on my VOIP phone. Can These attorney's do anything to track as to where I am. How do they find relatives etc. I have been reading on the forums that they usually track down the person by calling relatives and friends. It is not that I want to run away from the debt. I basically have no money to pay them back and am scared of getting sued. Please help

No, these law firms cannot track you outside your country, because the International laws differ across countries. I'm not sure how they get the number of relatives and friends, but they can definitely sue you for the debt and bring a default judgment against you.

Yes, the creditor can bring a default judgment against you even if you are not in the country, but they will start the process of collecting the judgment amount through garnishment once you return back. Judgments has its own SOL and the creditor can recover the debt within the SOL if you return back during that period. You can also go through this thread in the forum http://www.debtconsolidationcare.com/collection-agencies/amex-usdebt.html .

Here are the facts. James A. West Law Firm is in Houston and is a knowingly illegal firm. They still operate; but have gone silent lately. Do not talk to them if they call. Do not give them info. They use bully-tactics and only ask for your account info over the phone...this is illegal.

James West's office is a bottom feeding, junk debt buying, rent-a-lawyer office that relies solely on scare tactics to collect debts they cannot validate. Send a DV certified mail and if they do not properly validate the debt, sue them in federal court for violating the FDCPA so they end up paying you. In my experience, they are full of hot air, their collectors are dumb fools, and they all fold like a house of cards when held to the law.

does anyone have the 1-800 number that they gave to you to call them back, I also received a call from them and they told me that they would have to send all the paper work to a magistrate in my area as I do not even live in the state of Texas. I already agreed to make payment arrangements and now and not so sure I did the right thing!

This is my problem with these guys.... they are calling my home because my husband and his father have the same name. This is my father-in-law's debt and when I tell them that they have the wrong number they do not believe me - even though they verify the birth date and I tell them my husband is not 65 years old!! I guess they are so used to getting the run around - they dont believe the truth when they hear it.... but I am getting tired of saying the same thing over and over - it's not my debt!

It is what it is. You just tell them you would like to clear up but do not have any money at this time.

Yes I got problems too, they keep calling me and scaring me to make settlement of my debt which is I did not open it myself. I wanted to pay but the thing is I did not do it, I not even around the state when they told me I purchased for a gas. How would I know those debt collectors are legal or illegal? I keep asking them to send me an activity of that account and prove show my own signature, but they NEVER send it to me.

I keep getting calls from them also and I live in Wisconsin. They do sound threatening. Not sure what I should do. My husband has been laid off for over a year because of the decline in the union position. I would pay if I had it. The man that is calling, Mr. Phillips is extremely rude on the voice messages, and has no hesitation in calling my work and telling the receptionist exactly why he is calling! Is this a legit law firm?

Does your company record calls? If so get a copy of him telling the receptionist why he is calling because THAT is third party disclosure and violates your rights.

For those of you who can't pay: The economy being what it is, you have to take care of yourself and your family foremost. if you HAD the money you would pay it. Any court would see that. What you need to do is first make sure the debt is legitimate and the company collecting upon it the right one to be doing so. You do this with a debt validation letter.

If they validate it, then you can send a letter of an offer to make payment arrangements. Explain the amount you are offering is all you can do at this time. If they don't accept it, keep sending it ever 30 days or so (all by certified mail return receipt). If they sue you, break out your folder of sent proposals and show them to the judge and explain that you were trying to pay your obligation but the company kept refusing.

Unfortanatly, I fell for their scare tactics... And They deducted payments that I did not authorize... Do not give them your account information. They are not professional, use bully tactics, LOW class!!!!!!!!!!!! IF I had to do it over again IT WOULD HAVE BEEN ON MY TERMS OR NOTHING AT ALL!!!!

Does the credit repair books tell how to negotiate debt? Or about debt validation? Or what to do if the companies like James West doesn't validate the debt within the 30 days of receipt from a DVL?

I used to work for this company but was involved in a mass layoff as of friday, september 24th. Needless to say, not too happy. Mike's not an attorney, but he is actually a pretty good guy. he'll help you out if you need payments. Believe me, asking for the balance is not in vocabulary, despite all the teasing we do.

They just called me and I set up a payment plan. But are they going to take my money and say I never paid? I am scared of fraud with this company. I dont want to give $1,800 to just anyone. Some who has actually paid debt off with this company please let me know if it worked.

Jemily, the number for them is 1-800-568-4116
