You need to send them a validation of debt and cease communication. Also send them a violation of FDCPA stating they used threatening language, the use of an attorney; making you feel they are a law firm. Tell them they have mislead you and caused you stress. Tell them it is not legal for a collection agency to make a statement of we need a payment by tomorrow. Again tell them they are in violation of FCRA and FDCPA. Good Luck. Send all this certified mail TODAY?

Also there is case law stating an attorney that allows a collection agency to use their letter head is liable under the FDCPA as well. Its a lot of work, but its worth it. I can provide case information if needed.

Another thing that they need to do is to send you a dunning letter within 5 days of their initial contact. It will have the contact info for the collector, and the "mini miranda" that spells out your rights. I believe that this is an FDCPA violation if they do not send it. If you talk to them on the phone again, make sure that they have a mailing address for the letter to be sent to.

first thank you all for your gracious replies... well first of all the only letter we received from this lawyers "office" was on a yellow paper stating creditor, which they have as pinnacle financial group llc, original creditor the bank name, and the amount owed. what i found funny was on the bottom of this letter is said "no lawyer from this firm has reviewed this case. My question is if they try to take the 400.00 out of our account they will cause us great financial hardship.. the debt is 2 years old. is this letter what is called a dunning letter? i have no assets to my name no vehicle which i lost because of my situation i owe americredit 19,000 due to the dealer screwing us royally. its really frightening this situation as im sure others are in too. again please keep responding we need all the advice we can get. god bless this site and all of its members. thanks so much for your kind support....

If you gave them your banking info then you need to immediately close that account and open a new one. Also send them a letter revoking any authorization to access any bank account. Also send them a debt validation letter and refuse to speak with them on the phone except one last time to inform them you have send a certified letter revoking any authorization, also tell them you provided a copy of this letter to your bank. Don't let them try to tell you that once you give authorization thats it, because it is not....you can revoke at ANY TIME.

please help with this issue, i ahve been paying a credit card debt off for several months now at 25.00 month. i am on social security and disabled besides my husbands social security this is our only income. recently our checking account was closed by us for unauthorized use, but not by these people. last evening i received a call at about 7:50 p.m. from a gentleman from NCA( National credit adjusters) who handles this account. first he said "are you in hiding? secondly he said he wanted my checking account info. i said no! i sent a money order to them for payment for september as agreed and he wants us to get a prepaid debit card to put the payments on that.... question can these agencies refuse money orders for payment? help please dont know what to do.... thank you
