hello, im a newbie to this site and need help or advice desperately. several years ago i became disabled from a stroke and back surgery. i tried working again to pay off some of my credit card debt. i was laid off by phone! i couldnt continue paying this debt. up until then i was in good standing. well anyway i get this call from a woman answering the phone with "attorneys office" so i ask what the issue is. its this credit card. after speaking to a gentleman who asks if we want to seetle this debt we say absolutely then connects me with 3 other people. finally a woman ny the name of jeannine says we want 300.00 by the next day call me by 7:00 p.m.. well as hard as we could we tried to beg borrow and steal to find this money but couldnt. so i call her back and tell her i cannot get the money she requested could we make some other arrangement. well she said that this is a refusal to pay! so my wife calls her back and her irish temper went up and asked questions then the amount changed and she said 400.00 by next month. my wife is also disabled. so because i was afraid of retaliation i agreed to the arrangement of this plus 150.00 per month. the total card was 3000 it is now 6.000. my wife researched this lawyer and found in nj he has been suspended from the bar has 7 complaints against him and then was reinstated in 2002. we are now living on 1531.00 total disability between the 2 of us. what do we do now? any advice or suggestions? my wife is fuming and she has a serious heart ailment we arent refusing to pay these people but what do we do? where do we turn to? please help? also they said the monies would be taken out by another party and put into the lawyers fund? thanks for all replies we are afraid of going completely under now......we are good people and made some big mistakes just like everyone else but we are also trying to pay off other debt with the little income we have plus our present basic living expenses.

Don't do anything yet! How old is the debt? Since they have contacted you, they have 5 days to send you a Dunning letter. It is possible that this may be out of SOL and you might need to send a DV letter that you can find on this site and edit to your own needs. More info please!

Ok first I am not an attorney, but this is my first hand action by me.
You need to send them a validation of debt and cease communication. Also send them a violation of FDCPA stating they used threatening language, the use of an attorney; making you feel they are a law firm. Tell them they have mislead you and caused you stress. Tell them it is not legal for a collection agency to make a statement of we need a payment by tomorrow. Again tell them they are in violation of FCRA and FDCPA. Good Luck. Send all this certified mail TODAY?

Another thing that they need to do is to send you a dunning letter within 5 days of their initial contact. It will have the contact info for the collector, and the "mini miranda" that spells out your rights. I believe that this is an FDCPA violation if they do not send it. If you talk to them on the phone again, make sure that they have a mailing address for the letter to be sent to.

first thank you all for your gracious replies... well first of all the only letter we received from this lawyers "office" was on a yellow paper stating creditor, which they have as pinnacle financial group llc, original creditor the bank name, and the amount owed. what i found funny was on the bottom of this letter is said "no lawyer from this firm has reviewed this case. My question is if they try to take the 400.00 out of our account they will cause us great financial hardship.. the debt is 2 years old. is this letter what is called a dunning letter? i have no assets to my name no vehicle which i lost because of my situation i owe americredit 19,000 due to the dealer screwing us royally. its really frightening this situation as im sure others are in too. again please keep responding we need all the advice we can get. god bless this site and all of its members. thanks so much for your kind support....

If you gave them your banking info then you need to immediately close that account and open a new one. Also send them a letter revoking any authorization to access any bank account. Also send them a debt validation letter and refuse to speak with them on the phone except one last time to inform them you have send a certified letter revoking any authorization, also tell them you provided a copy of this letter to your bank. Don't let them try to tell you that once you give authorization thats it, because it is not....you can revoke at ANY TIME.
