Hello, I have a question? Can a collection attorney send you a letter giving you 30 day to respond the normal letter.

15 days later before you respond have you summons complaint filed with the court? Attorney is representing Unifund


The 30 day period is not considered a grace period. File a Motion for Discovery (ask the court how) so you can get a better and much more comprehensive verification of the alleged debt.

It is for New York and may vary in some details with your state. For more information, Google your local county civil court website which should have local procedures and any necessary forms.

Unfortunately if people continue to send DV letters for everything, more and more collectors will be willing to sue a lot faster. The process is there to help people who are being accused of owing monies that they do not owe, and not a stall tactic.
