I sent Portfolio a validation request with the usual information requested ie:

What the money you say I owe is for;
Explain and show me how you calculated what you say I owe;
Provide me with copies of any papers that show I agreed to pay what you say I owe;
Provide a verification or copy of any judgment if applicable;
Identify the original creditor;
Prove the Statute of Limitations has not expired on this account
Show me that you are licensed to collect in my state
Provide me with your license numbers and Registered Agent

To which I have received a response letter from them that I do not think validates the required information at all. The meat of the letter says:

Re: Verification Information Concerning PRA Account/Reference No.: xxxxxxxxxxxxxxxx NCO PORTFOLIO MGMT INC.lDISCOVER CARD

Please contact us if you would like to receive a payment history of payments that have posted to this account since our company purchased this account.

This is my first time doing something like this but it seems to me that they haven't validated anything other than it's a discover card account from thirteen years ago. There is no mention of this account on my credit reports and I haven't had a discover card in over ten years. Can someone please advise me with what should be the next step. Thank You.

can you recall the last payment on this card?also what state you are in.it sounds past the SOL(statute of limitations)if so you are not obligated top pay,and they can't sue on it either.please try to answer my questions the best that you can.it will go a long way to determine your next response.i see you mentioned you haven't had a DISCOVER card in 10 yrs.if that is the case when was the last payment?

well then.thank them for there response,but since this is past SOL.they can never contact you again about this because you are not paying it.end it with an FOAD.send it certified mail return receipt.

they can't send a 1099C unless the person pays them.if they did that on a debt out of SOL,and the person didn't pay.that would be lawsuit time for the person against portfolio.

that is because nobody contests those.there has to be a paid settlement to assess a 1099c.on the other hand if they do that the debt is no more.as stated if they file that form they cannot sell it again and the debt is technically gone as they are filing as if it was settled,and the remaining balance was written off.if they sell it they can be in trouble for tax fraud.don't know why people don't contest the 1099c.maybe to get rid of the debt once and for all.
