I was curious if after you go to court and lose a lawsuit. If you don't have the amount they request monthly. Can a judge force you somehow legally to pay what the creditor demands? Lets say for instance i owe 5000 dollars and the creditor wants 250 a month. If i lose the lawsuit and i don't want to pay 250 a month, can a judge force me to somehow legally, or will they just garnish my wages for the max amount?

well the judge will take into account everything.expenses,income.everything.if you truely can't afford to give that much.i don't see a judge ordering that monthly payment in that case.

if you can't afford it.the judge won't order it.only if you break the original payment outlined.then maybe, but no judge will force someone to pay what they can't afford.the monthly will be what you can afford.not what the collector demands.

I guess i don't really know what i'm asking here. I think what I want to ask is can a judge legally bind you to a payment amount instead of garnish my wages or something. I live in a 10 percent state (gross) NJ.

Hypothetically, a judge says I order you to pay 250 dollars a month or a flat out 5000 and regardless of what I say, thats what he decides. What if I cannot afford either. Can't they just garnish my wages, which is less than the 250?

I'm sorry , i've just been going through a helluva lot lately and this situation has just added to the flames. Things in life are very rough right now and i am just trying to know as much as I can about just one situation.
