Pa judgment

Im on SSD i got a judgment from a unsecured credit card against me my wife is aslo on SSD What can they take? the judgment is in my name not my wifes. She owns a car and just got her dads truck as he has recently just passed away. We dont have much just the basics tv computher ripped furniture 4 children. I have nothing. Thanks


Hi Just me,

First off, if the judgment hasn't included your wife in it then it can't be executed against her. And, secondly, social security income can't be garnished to satisfy a judgment. I'd be surprised if they can take anything from you.

Do you have any other asset? Saving account? Or, any other source of income?

Though the lender can't directly garnish the SS income but once the money would get deposited in saving or checking account, it can be taken from there.

You may wish to file an Exemption of Assets for your bank account, most especially if the only deposits to it are from SSD.

Social Security Disability is exempt from garnishment but you want to be on the safe side, as stated above.

No i dont have anything no savings no other income nothing. Thank you for your reply

How do i file this?
Yes I went and the magistrate just seemed to put his fingers in his ears when I spoke.
