lvnv backing me in a corner. please help

Ok.... on Saturday i get a paper in the mail from the courts saying i have a levy against me and the company lvnv lending is behind it and will come in and take property from my house. This is the very first i found out that lvnv was even trying to collect money from me. i freaked out of course and ran to the courts and filed an objection (not sure of the legal terms for it) no one at the courts or even legal aids office gave us any info as for what to do. so i came home and spent 2 days getting all the info i can. i learned about what to do. however... im well past the 30 day summons time. i was never sent papers that lvnv filed a summons against me. so i clearly wasn't is court and so lvnv won that. then they filed a judgement against me. again. i was never served with thse papers either! so again, i wasnt in coourt to challenge the judgement. now its to the point there they got the levy on my property. am i to late to even file for a proof they even own this debt? i look so bad to the courts because i missed 2 court dates.

so i go look up my credit report to see the info this company has on there and oh my god...LVNV is not even on my credit report!! they say they are collecting for citifinancial. they are on my car but the account is closed and it said the loan was transferred. now if it was....why is lvnv trying to say they are collecting on the 5 year old loan for citi? why isn't lvnv even on my credit report? how can i even know they have this debt if they aren't on there?

does this sound really messed up to anyone else? the old debt was closed out i guess right after they repoed my car. i never heard from citi again stating i still owe money. for all i knew, they were able to make enough money from the aucton sale on it an i didnt owe anything anymore.

can anyone give me good advise?


go back to the court and ask how to file an objection for improper service as you were never served.the court clerk should help you with that here.

sometimes,but if a place is assigned and didn't buy the debt.the collector might not appear.they wanted to give you that impression

the SOL starts 4 months from the date of last payment.that is what transferred means.that doesn't take away from the fact that you weren't even aware of this as you never served.the SOL varies state to state.

too much gray area.i would focus on the improper service.then when the judgement is vacated request validation then.to the guest.i'm also sure you will contact.then lie out of your ***.that is what you do best.

I got a paper in the mail from a lawyer for lvnv saying there was a judgement against me already. Attached to the letter is a list of 10 questions where they are asking me my credit card info, my bank accounts. The type of cars i have, models and such. SS #, where i work and how much my salary is.

Are they legally aloud to be sending me these things? It says if i fail to answers these questions, the courts will hold me in contempt. What is funny is that.. at first it says "you must answer all 10 questions" then later it says "Even if you file against the judgement, you must answer all 12 attached questions"

I received statement / letter earlier this month from Creditors Interchange listing LVNV FUNDING LLC as current creditor and a line that says "RE: the account with RESURGENT CAPITAL SERVICES LP". they have a correct original creditor (credit card) and last four digits of the account.

shortly after the date on the letter, I received my normal statement from the card company so I sent a request for validation letter to Creditors Interchange.

on the second page I got from Creditor Interchange it list a number of "Sherman Companies". if anyone is interested, I will post the list of these companies.

I pulled my credit report and found the following. A charged off debt from Sams Club and states "purchased by another lender". Right below it shows LVNV Funding for Sams club at a doubled amouth stated "placed for collection". Are they listing themselves as a factoring account? Is what they did legal? Also, I've been trying to find out where to look to see if a collection agency is licensed in the state of IL because I'd like to check if they are.

I found this on the State of Illinois website. Does this mean that they are licensed in the state of IL even though it shows Las Vegas NV?

-UPDATE!!!!-
Hi! I am the original poster who made this thread. I just wanted to update! I went to court and was able to get the levy AND judgement vacated for improper service!! Double win!!!

So now the case has been re-opened from the beginning. So i guess its time to push up my sleeves and get ready to fight this battle from the beginning like i should of been able to do! DV letters are going out tomorrow!!

I must say.. i was disappointed that they actually showed up for court.. but.. i came to find out.. there were about 4 other cases there involving them. Hmmm.. i would love to thank everyone here who read and commented. This site is so helpful. I was actually able to give someone who was also in my shoes in court that day, information that i learned on here, that they were completely unaware of. They were going to try to start paying these people money for a credit card they hadn't used since like 1992. I was like "Whoa.. SOL on that one.. I would look into that before you agree or start making any payments"

Hi.. the original poster here again. I just wanted to update and say that we won against LVNV! We bombed them with DV letters, and Motion for Discovery letters too, and the day of the court date.. the slimes fax a letter to the courts telling them the mater was settled! I was like "What? i didn't settle for -anything!" We were told LVNV pretty much chickened out and said it was settled and no parties owed any money. Those slime balls! I was honestly really scared. I thought they had the papers to prove they owned the debt and would make us start paying. I am soooo happy to find out they didn't have -anything-! Thank you guys SO MUCH for all the help! The laywer who was trying to help us, even said that he learned a lot of new things about this company, from this case. And he was glad he did. (I also found out the judge that was at the court that day to hear our case, hates LVNV Funding and hates what they do to people.. So he was happy we won as well)

That's the best news I've heard all day! Congratulations on beating the slime!!!

Here's an idea for ya... How'd you like to keep right on doing LVNV in the eye? Why don't you sign up as a member of our community, and spend some quality time helping out other folks who are in the position you were? I promise, it's a satisfying hobby.

Oh, um yes it was vacated dude to improper service. LVNV doesn't know how to spell my name correctly.. so they do not show up on my credit report at all. The old debt owners wrote it off in 2004. My name isn't the only name in the whole thing, and sadly, they did spell my mothers name correctly.. and i worry more about the judgement being on her record.
