I'm currently in the process of filing bankruptcy and VIP has assigned my loan to this collection agency. I told the rep this and she stated that they could still take me to court for writing a bad check. Should I be worried about this? They called again today and told me that if they don't hear back from me that they will start proceedings. Should I worry or let my lawyer handle this.


Just putting this 'out there'. I know just about all of us have had PDL nightmares. We've taken out PDL's for one reason or another. And I, too, understand, that CA's get involved, when the ORIGINAL amount barrowed is not paid back. But...how can CA's legally collect on the high % rate (fees and everything else..) on a PDL, when so many of PDL's are illegal in the first place?

thanks, I was kind of worried because she keeps calling and leaving me messages that they will be filing bad check charges against me and I don't want to go to court. I did notify my attorney and they are illegal in Maryland.
