I was recently contact by a Robin Carter from A. S and asscoaited regarding a Payday loan I took out with National Money Store. She claims she sent me paperwork but I never received anything. I took this payday loan out last April and since I had to close my account to get my finances in order, I didn't even recognize the payday loan because they never contacted me for their money. I went on their website and logged in and sure enough , my account is in collections for $271 dollars and some change. The funny thing is Carter is saying it's for $510.00. She somehow got a hold of my mom's phone number and I know she didn't get it off my application because I never out my mother's info on there. She told my mom she has been trying to contact me and I've been ignoring her and that this was a serious matter, that I am in trouble for fraudulant checks. Isn't it illegal for her to disclose that info to my mother?
So I call her back yesterday and told her if I could set up a payment with her, I only had $50.00 but was happy to give it to her. She says she can only accept the loan amount as a down payment which is $200.00. I told her I couln't do that and she advised me to ask someone to lend me the money because she will not be able to hold my account longer then today, Friday Sept. 11. She's going to file a claim with my county.
I will be calling her today asking her to send me validation of this debt, then I'm going to send her a cease & desist letter. I live in Florida, my question is, does she have to be registered in my state to collect this debt? I've heard some awful things about these people, I wonder if anyone has ever actually been serviced papers by them? and am I taking the right steps in this matter? Please help, any advise would help at this point

Have you ever received a dunning letter (letter of collection) via the mail from these people? Don't admit or deny to owing this bil and do NOT give out ANY of your account information over the telephone. FDCPA (Fair Debt Collection Practices Act) states that after the first initial contact with a debtor, the creditor is bound under the FDCPA to send you a dunning letter. Google the FDCPA and educate yourself on your rights. If they are saying they are going to file a claim in your country that leads me to believe this CA is in another country. I would definitely bring up the FDCPA to them if they call again. You have rights too, make sure you know them and understand them before you speak to them on the telephone again. This sounds all too fishy to me.

When I spoke on the phone with this lady, she wanted me to send her at least $200 so that further legal action would not be taken. This seems to be the M.O for these people. They call you at the end of the week to let you know you have 48 hours to co ply or else the case leaves their office. They are not located in another country, I believe they are in Texas. I found the BBB site for them through this message board and it turns out that the BBB revoked these peoples accredation for violating rules and not keeping up to code and another thread claims they are being investigated by the states attorney generals office. What should I do now that I've sent them the debt validation letter? I also put in that letter that any contact be made by mail only.
