Help! Threatening Calls from "Attorney"
Date: Tue, 09/29/2009 - 19:11
Good evening, everyone. I apologize for the lengthy post, but here goes:
I currently have 4 outstanding PDL's with the following:
Check Into Cash- $345
Midland Financial- $150
PaydayOne- $1000
AmeriLoan- $200
I have searched the LA Secretary of State and CIC is the only lender that has legal corporation in Louisiana. They are also the only company listed on the OFI website. I have checked my records and it appears that I have paid $180 to Midland, $240 to AmeriLoan, unknown how much I have paid to PaydayOne and nothing to CIC. I have began using PDL Assistance to settle the debt. I received an email in early September from someone with a company called "iCollect" stating that it had been turned over the collections (the email did not state that it was an attempt to collect a debt) I finally received a call from someone claiming to be a "Civil Claims Investigator" located in New York with a company named C.A.R. & Associates. He claims that they do not own the debt but have been retained by Midland. He then bullied me into talking to the "attorney" in the office. However, I believe he was disguising his voice. I called Midland to see what was going on since I am working with PDL and they advised me that they no longer own the debt and have no further information and do not know who I should call regarding it. Please note that the "investigator" claims they do not own the debt either and state that Midland owns it. I asked for a letter and they claimed they were going to send one, which took 3 days. Once I received it, I called them since the letter states that I owe $440 on this $150 loan and that I must pay it to avoid legal action. I was then transferred to this rude lady claiming to be the manager who stated I had 24 hrs to get back to them or they would began procedures to investigate my assets to see what they can take the pay back the loan. I advised them that they need to contact PDL but she advised me that they don't work with debt settlement companies. They finally called back tonight, but I ignored the call.
After all of this, I am wondering how far they can actually go. Will they really spend the time and money to "investigate" my assets and sue me? They are also trying to claim that I have made no payments even though my bank statements clearly state that I have made payments of $180. I am open to any and all advice as to how I should deal with them!

Are these lenders legal in your state? If these lenders aren't legal then you have overpaid them already and might demand refund. Just wait for the experts to appear.
