Well, it seems that GEMB has hired both Encore & Allied Interstate to collect on their behalf. I added this information on my other thread, but I thought since this is a new collection agency, I should start a new thread to find out how to proceed.

Allied Interstate started calling me last week. Because of their reputation, I believe they are the ones who are incessantly calling my sister looking for me. It's either Allied or Encore (who I haven't heard from in 1.5 weeks).

Allied is calling from (877) 225-1118. I sent them a DV with a limited C&D. Yesterday I received a letter from the original creditor GEMB, the original creditor, with my past statements and pressuring me to pay. I did not DV GEMB, I DV'd Allied Interstate AND Encore.

Allied Interstate received my CMRR DV & limited C&D on October 30, 2009 at 10:27 a.m. They have called 9 times since receiving that letter in 1.5 days - and a total of 11 times in 1.5 days, and do not leave messages on my answering machine.

From what I understand, collection agencies are only allowed to contact me 1 time after receiving a DV/C&D to let me know they received their lettor or to let me know of their intentions. Is that correct?

I'm trying to find out what are my next steps. I know I have to file complaints with the FTC and Attorney General. But how do I go about filing suit against them? Do I look for an attorney on NACA? Can I file against them on my own?


No, I have not spoken with them. Whenever I do try to answer their calls, I get silence followed by a busy signal. Why wouldn't this fall under an 1, if they are not leaving messages and not speaking to me when I answer? Why would they call me (now up to 15 times) in 2 days if they have no intention of speaking to me, unless it is to harrass me.

UPDATE:

I called Allied Interstate at the number that keeps calling my house. I spoke to someone who was very nice, but sounded very inexperienced. I would not verify my (or my husband's) social security number, but I did verify my mailing address. He kept asking if I was refusing to pay and disputing the debt. I said I detailed it all in my letter asking for validation. He asked if I've received validation from GEMB, and I told him I have received no validation from Allied Interstate. I asked them to please communicate with me in writing, as requested in my letter. Then he told me their records weren't updated and he will note my file not to call me again.

I guess we'll see what happens.

Ok....they got your C&D on thursday. Places like Allied use a mailing company or a PO box...the certified mail is signed for at this site and then is sent by courier usually the following day. That is how our mail worked....anything at the post office by 8 or9am arrived at our office by 10am or so...and then it could take 24 hours or so for it to be entered into the system.

Thank you, Soaplady. I sent them a CMRR to their physical address and another copy first class to their P. O. Box address. I'm trying to stay ontop of them, because GEMB still calls for it every day, and now they have 2 CA's calling for the same account.

Update:
As of 3:00 p.m. on Sunday, they've called 6 more times, after telling me they received my DV/C&D letter and updated their system not to call me again until they provide validation. I answered 3 and heard someone say hello back, but quickly heard a busy signal, as the call was disconnected. Seems like harrassment to me.
