I received a collection letter from Cavalry regarding an updaid credit card form HSBC for $1687.48 and sent a DV letter via certified mail which was received and signed for by them on 11/9/09. Today I received notification that they have placed the account on my credit report as of 11/1/09. I know the debt is mine but I want them to validate it before I enter into any payment arrangements with them. How long should I wait for them to respond? If they don't respond soon can I request to have it reomoved from my credit report. Also, how likely am I to be able to come to some type of agreement with these folk? Any help would be appreciated.

They have no time limit to respond to a DV request unless you live in TX. Then they have 30 days. If your DV was timely, then thye must cease collection efforts until validation is provided. They must also list it as "In Dispute" on your credit reports. Calvary usually folds pretty quickly to a DV request. How old is the debt? What state do you live in? When was the last time you paid on the account?

Actually there is no time limit specified for the collection agencies to reply on a debt validation letter. But the CA should stop all the collection activities till they validate the debt. Wait for a month, then you may send another DV if they don't respond to this one.

Now, if they don't reply at all, you may then dispute the issue with the credit bureau in an effort to get the entry removed from your credit report.

Lori, it's hard to say whether or not the CA would agree to a payment plan. You can search their name in the site to see if any member has a success story with them.

But wouldn't everyone agree that waiting 30 days is more than reasonable
and if collection efforts continue without validation, one should consider suing

actually in texas a collector or JDB or anyone collecting a debt must validate within 30 days.i do think if a collector or JDB can't validate then it should be dropped entirely.JMO.

I submitted a debt validation letter to Calvary Portfolio since they were reporting a collection account on my credit report. Today, I received a copy of a judgement that was filed in court for $1916.00 from Providian National Bank. The judgement was filed in September 2005. Is this considered proper validation of debt? I do not remember ever receiving this judgement from the sheriff's office, but my memory is not good anymore. Providian has charged off the debt and Calvary is reporting it on my credit report. Do I have any options left?
