Can aperson sue a collection agency that repeatedly calls you when you do owe the debt, but a relative does? I have a male from Pentagroup, ph. # 703-291-9026 that is calling me as early as 8:00 am and I have asked him repeatedly, to stop calling my house as I don't owe them anything, yet he continues to call. What can I do to stop the calls?


You need to send them a cease communications letter certified mail, return receipt. If they call after that, then they have violated. I am assuming you mean you don't owe the debt but a family member does. Just send the letter telling them to stop contacting you.

If they have told you anything about this debt (not yours) they have also violated right there as they are not supposed to tell you anything.

Pentagroup is not accredited, funny thing, and BBB gives them a D+!!! They are trying to sue me for an account that was with a company that doesn't even exist anymore. So of course third parties buy out the contract and try to get as much as they can. But a lot of the time they only harrass you and can't make you pay, especially if it's not theirs and they have no rights to it.

You need to go look at the Fair Debt Collection Practices Act of 1974. They CANNOT threaten to sue unless they are going to actually do it. It is harrassment if they are threatening you. When you answer the phone, and it is them, tell them that you are recording the entire call. Ask them if they are familar with the Fair Debt Collection Practices Act, (they will tell you that it does not apply to them, and it does!!!)

I am getting calls from the following number 832.615.2143 asking to speak to my dad and then really asking to speak to my neighbor. It appears my neighbor has somesort of account with Pentagroup Financial and he hasn't responded to them so now the company is contacting my household which is across the street from him in order for us to give him the message. I have no ties to my neighbor, we are not related and I have no Business with Pentagroup. Is it even legal for them to call me???? The calls are a harassment to me because I work grave yard shifts and the calls are as early as 8AM is while I am asleep. What can I do to end this harassment? I feel this company is invading my privacy and my neighbor's. Is it even legal for them to call me and ask me to be the messenger for my neighbor?

Tell them the next time they call that you are not a messenger service and if they force you to send a cease & desist the very next call will net them a lawsuit. If they continue to harass you, send them a cease & desist letter certified mail return receipt and if they call even one more time after that, take them to court....you have them for an easy $1000 plus your cost of court.

I am getting calls they wont tell me what for they are really rude and it is for my fiance and he is deployed for a a year. I tried to call back to get information but no one would say anything. Dont they have to stop collections when they are on active duty? isnt called the solder and sailors act?

Was this for a payday loan, if so was it Internet based, and what state was your fianc?? in when he obtained the loan?

I am also getting calls from Pentagroup and they keep asking me to have my lawyer contact them ( I don't have a lawyer) I want to be able to send them an amount every month but they claim they can't take a small amount, I either need to settle for 80% of my debt or send them 3500.00 to get a monthly payment...I don't have either amount!!! I don't even want to talk to them because I know that they will just ask for my attorney or send the money there is nothing that they can do for me. Help!

Let me guess--youre a debt collector with no clue. Most of your own industry--yes, that means most debt collectors in this country--are stuck with bad credit themselves. Obviously, the only satisfaction you get out of life is badgering and harassing people on the phone so you can forget about your own answering machine.....five bucks says your caller ID is filled with "out of area" and "toll free call" entries.

Seek life elsewhere. This site is for people who need help....and the kind of help you clearly need is too much for even this place.

This is free infomation: I am a former USMC Legal Assistence NCO, in the JAG for many years. All servicemen and women are covered by the Soldiers & Sailors act. Since it does not apear that you are married or in the service yourself, you are not covered, but your boy friend is. All he has to is contact legal assistance where he is stationed and make a FREE appointment. What legal does is send a letter from the Staff Judge Advocates office advising them they are in violation ofctge said act. We have even sent letters to courts and civilian judges that they are violating federal law. That should end the unwanted calls and letter.
Also this applies to any duty station out of the one state. If this were a Nevada debt and the serviceman is stationed in California, the act still rules.

I had been getting a call from this company as well, and when I asked for the name of their company he wouldn't give it to me until I gave them my full name. His exact words were..."Either you give me your FULL name and I'll tell you what company this is, or you can hang up" I hung up and he repeatedly called me immediately after. If you really have a problem with them, report it to the Better Business Bureau. Apparently the BBB accredited this company and gave them an A+ and has only had around 130 complaints against them. ARE YOU SERIOUS!?!?

I am sure their mama is really proud of his line of work and the WONDERFUL education they have received. This loser is probably so far in debt themself that they have to work for one of the companies to keep them from breathing down their own neck. Most of these loser collectors probably would crap their pants if someone really stood up to them on a street corner somewhere, their powerful only when hiding behind a phone.

if they threaten,or disclose anything your sister should file a police report,and an AG complaint as what they doing is against the law.they are only allowed to call to get your contact info.nothing else.have her do that and i wouldn't talk to them as if you read the thread they are a bottomfeeder that should be reported and ignored not paid.
