I was sued in small claims court and the person that sued me won. However the next day he emailed me and went to the courthouse requesting the judge lower the amount he sued me for to $1.oo, that he did not want the money from me but rather to prove his point so to speak, I paid him with a check for the $1.00 the very next day, then two months later he goes back the justice of the peace and states he wants to accept the original verdict and then almost a month later send me a registered letter stating he decided he wants his money and that I have till the end of December to pay him. What rights do I have, is his letter that he filed with the court not a binding document making me only liable for the $1.00? I can't get an appeal or re-try as he didn't do this till two months after the original verdict and my 10 days have past. Any help is appreciated!


Whoa! Seems to me that you would definitely have some recourse but I'm not sure what it would be. Did you happen to put on your check "Paid In Full" ? If you did then theres your receipt. Keep checking back for more replies, I am sure there is someone here who is well versed in the law that applies to this.

This is one of the craziest things I've ever heard.
I'm not an expert but it seems like since you have the email, the check and his court filings there wouldn't be any problems putting an end to it.
As stated above, you may need to speak with an attorney. I have been in situations before where I've spoken with an attorney on a free consoltation and they have just told me what to do and I've handled it myself without having to pay, perhaps this could be the case with you???
But, I would definitely fight and not let him get away with this
