Whoa! Seems to me that you would definitely have some recourse but I'm not sure what it would be. Did you happen to put on your check "Paid In Full" ? If you did then theres your receipt. Keep checking back for more replies, I am sure there is someone here who is well versed in the law that applies to this.

I'm not an expert but it seems like since you have the email, the check and his court filings there wouldn't be any problems putting an end to it.
As stated above, you may need to speak with an attorney. I have been in situations before where I've spoken with an attorney on a free consoltation and they have just told me what to do and I've handled it myself without having to pay, perhaps this could be the case with you???
But, I would definitely fight and not let him get away with this
