Anyone been in my shoes? Judgements & Court Dates...

Hey all....first off, I want to thank everyone on this site for being open and honest and sharing their issues, resolutions and progress. I'm just glad I'm not alone... I can tell you this...the stress of having all of my debt looming over my head has caused me to have issues with anxiety and my stomach. Well....it is what it is...now I have to change it.

I am in Massachusetts. I just received a notice from a local district court stating "NOTICE OF EXAMINATION" in the top corner. It also states that this creditor (Arrow Financial Services, LLC) has a judgement against me for in excess of $21,000. I am supposed to appear at the court sometime in March 2010.

I've made offers via Certified mail and never recieved any responses. I did call the law office ( Gary H Kreppel, P.C. ) to see if I could settle, but they wanted a bare minimum of 50% all w/in 90 days. I'm trying at all costs to avoid a BK - as I would fall into a Chapter 13 in Mass. I was hoping to settle at 30% because I think I could pull that together within 90days...and get one of the big boys off my back.

Does anyone have any advice for me? Any letter that they'd recommend specifically? I want to hit this head on....but could use some advice. :confused:

Also - just FYI - I opted not to use a settlment company because they wanted 15% of my total debt - up front in monthly payments. My total debt is approx $60k. I just thought that was a ridiculous price to pay if there were going to settle at 50% for me....so why not try it myself and use the resources available to me on this website.

Have you not filed an answer to the summon?

Normally you get 30 days to reply to a summon and the court can enter a default judgement against you if you fail to record your answer within this period.

What happened with the summon?

I recieved the summon - and it had no dates on it. I didn't file anything as I wasn't sure what to do with it.

Couple of questions - on my credit report -it shows that my largest credit card - $21,000 has been discharged - do I still need to pay it? If so, I am going to want to settle at this point obviously - what should I offer as settlement (lowest amount)?

It says discharged.

It shows that Arrow Financial is an assignee of Washington Mutual. Arrow Financial has gotten a local law firm to represent them. Gary H. Kreppel, Esquire. A judgement was entered against me on 08/18/2009 and now I have to appear in court on 03/02/2010 to "submit to such an examination" - Balance is $21,500

Now if I am offering settlement letters, who should I send them to? WAMU? ARROW FINANCIAL? THe Attorney? At this point in the game what would people suggest as a settlement offer? 20% was rejected.
