lawyer trying to collect an overpaid CMG loan in Texas
Date: Fri, 12/18/2009 - 07:30
The principal was $250. I have paid at least $375 in fees before I closed my bank account.
Now this lawyer says I owe $400
CMG never made any contact with me except an email to tell me it had been passed on to a company called Debt Management Partners. Never heard from them at all.
Any ideas on how to proceed? I believe this loan was paid as CMG are illegal in Texas.
Should I write this attorney or ignore it?

Even if this letter wasn't received via the mail and received via email you still NEED to request debt validation. The law gives you 30 days of which to reply and request debt validation, read about debt validation at the link below:
http://www.debtconsolidationcare.com/validation.html
The letter you received should state (somewhere on the letter) you have 30 days to dispute this debt, if you do not dispute it within the 30 days it will basically be an admission to owing it. Or something to that effect.
Anyway, because this Attorney is attempting to collect this debt they must abide by the FDCPA (Fair Debt Collection Practices Act), click the link below to read about your rights:

Make sure you send this letter certified return receipt requested. You can retrieve a sample debt validation letter from this forum by typing it into the search box located in the upper right hand corner of this forum. I would also include a copy of your state payday loan laws, see link below:

I would inform them they are attempting to collect on an illegal debt and you will be filing a complaint with the FTC (link in my signature), your state attorney general's office and the BBB. And PLEASE follow through with these complaints. Keep a copy of EVERY piece of correspondence you send and receive from the lender and Attorney.
