Hello,

I sent a debt validation letter to LVNV Funding LLC, and received a letter from Resurgent Capital Services stating that "this account has been placed with Resurgent Capital Services." They responded with insufficient proof (a typed statement) of the debt. So, I sent out a second debt validation letter to Resurgent Capital Services.

Their second response stated: "We have taken the necessary actions to ensure you will receive no further communications from Resurgent Capital Services L.P."

They also enclosed an "original validation of debt that verifies this debt." The proof was a typed statement about the debt, not the original contract, which I requested in my second debt validation letter.

LVNV appears on my credit reports. Resurgent Capital Services does not appear on my credit reports.

What should be my next step in order to have the LVNV listing removed from my credit reports?

If you use the search box in the right hand corner you would get many information both on LVNV and Resurgent. LVNV is the assigner of the account to Resurgent and hence Resurgent isn't appearing in the report.

However, it seems that they don't have proper information to collect this debt and according to the FDCPA the collector should remove the item from the credit report if they can't validate the account.

Was the statement they gave to the effect of:

"As of the date of this communication, you owe $$$$$$$ on account number ****-****-****-**** which is now owned by LVNV Funding LLC. Should you desire to pay off in full, you should contact us at 1-888-665-0374 to determine the payoff balance as interest,credits, fees and or other permissible charges can continue to cause your account balance to vary from day to day."

If it is, I wonder how many other people they say this to and if a class action lawsuit would be in order???
