Not sure if this is the right forum for this or not but I need assistance on what to do. I received a notice from my mortgage company stating that my home was in foreclosure blah blah blah and that all the payments I have sent were just sitting in "surplus" because I was less then $100 short on one payment. So they have just been collecting the payments and NOT doing anything with them and now I have to go to Moneygram and pick up the ones that have been sent back (nice I know)

SO ANYHOW they have scheduled my house to sell in May.... I am trying to work out something with them but we are apparently not seeing eye to eye on my suggestion of automatic withdrawls bi-weekly. So I am considering bankruptcy as well. Does anyone know if you are able to declare bankruptcy and continue to keep your house and how do you do that

Yes I just called them (which is how I found out that they were hanging onto the "surplus" and sending them back to Moneygram) They are ordering the "reinstatement" to see what they can do. Good news is that since I apparently have money sitting waiting for me at Moneygram I will have some for the "down" payment if they get it situated.

They have a surplus of two (minus the $100 that I guess wasn't there so they couldn't count it as a payment) and I have to pick up one

He said that their "investor" would not allow any more loan modifications etc... so I am just trying to figure out ALL my options I guess

I don't necessarily want to declare bankruptcy -- it was just one of the "options" listed on the notice that they gave me. The one good thing about declaring bankruptcy would be that CashCall would lose and that in and of itself would make me feel better since they won't work with me either.
