Our mortgage company wont work with me for loan modification and have used all kinds of delaying tactics, and now they have given me notice to auction out our house next month 6 th of july.
We cannot afford to move. We have owned this 28 years old house for 8 years, and this is our only place to live. The Mortgage company GMAC it is a nightmare to deal with.
During our research ,Chapter 13 seems to be the only option or is there another way out ??
Any feed back folks, what should we do.

Thank you
Jay

A Chapt 13 would stop the foreclousre process. you need to get into a bankruptcy attorney immediately for them to evaluate your situation and give you advise that is specific for your part of the country.

the only other way to stop the foreclosure is to pay the back payments and make the loan current. So go to the bk attorney right away.

Chapter 13 is by far your last option and should only be attempted should you have exhausted every other possible avenue. I work for a financial advisement company, we specialize in all facets of financial/mortage/debt solutions for people that are in YOUR exact situation. We have products such as principle reduction programs that can help you stay in your home, and avoid both foreclosure AND Bankruptcy. if you would like to hear what we may be able to do for you, please feel free to email me. we just finished a modification after 18 months of hell. we were origanally with countrywide and they were bought out by bank of america. i found a really good web site called loansafe.org where they have forums like these to help and guide you through mortgage stuff. there is also the obama plan a.k.a. making home afordable plan that you might be able to qualify for. good luck
