I received a call from Portfolio Recovery and told them I would not discuss anything with them until I received a DV letter from them. Can they still contact even though I have not received the letter? I am a bit confused as to the way it works once you request a DV from them.

any requests for validation must be in writing by you.if you haven't sent a DV letter do so asap.send it certified mail return receipt.by law they must send a dunning letter 5 days after initial contact,but a DV request must be by mail sent by you.

No, the collection agency cannot continue with the collection process if they failed to validate the debt. If they do including the phone calls, they will be under violation of Fair Debt Collections Practices Act. However, you will have to send the collection agency a debt validation letter through certified mail, so as to keep written proof of your attempt to validate the debt. If they still contact you for collecting the debt without validating it, you can file complaint with the Federal Trading Commission, and your State Attorney General.

There are two things that I'll ask you to do. First, send the validation request via certified mail return receipt which can be used as a proof. They'll send you the reply within a week of receiving the mail. If they fail to validate the debt (which I think they would), they will have to stop all the collection processes.

They're also prevented from calling you over the phone if they cannot validate the account. But, if they don't reply to your debt validation letter and persist with their collection processes, you can file complaints against them with the Federal Trade Commission and your State Attorney General.
