they filed a judgment
Date: Fri, 07/16/2010 - 18:13
What do I need to do. First I don't owe this but can't prove it. Second I can not pay this. And what do I do about the judgment?
I recently got married. She has good credit but I do not. Can they go after my wife or her money?
Thanks for any help.

First of all you are most likely past the statue of limitations on the debt so they can try to collect but they can't sue you to collect. check what your state statute of limitations is. If you are past that time period, that means is they can not go after you or your wife for the debt. Even if you are within the statue of limitations they can not go after your wife since she did not sign for the debt. They can continue calling since you can't prove you paid it, but they can't force payment through a judgement. Tell them next time they call that it has been paid and that they are past the statue and not to call again.

If this was in MN, they use the "pocket docket" scam there. Legal, yes, but a scam IMO.
The creditor sends a summons but does not file it with the court, so the defendant suspects it's not real.
