I bought a comp in about 2002 while in the Service, my Mom paid off the $800 bal. by a CC (which she doesn't have any longer). About 2 years later someone tried again to collect this dept but dropped it after Mom also informed them it had been paid. Now they- Asset Acceptance have filed a judgment in the amount of $4,306 with our County District Court. How can they do that without Me being notified so I could defend my position? And they have all my financial info because they told me they needed that to verify that I would be unable to pay this. Since Mom doesn't have this CC any longer or the old proof of payment.
What do I need to do. First I don't owe this but can't prove it. Second I can not pay this. And what do I do about the judgment?
I recently got married. She has good credit but I do not. Can they go after my wife or her money?
Thanks for any help.

First of all you are most likely past the statue of limitations on the debt so they can try to collect but they can't sue you to collect. check what your state statute of limitations is. If you are past that time period, that means is they can not go after you or your wife for the debt. Even if you are within the statue of limitations they can not go after your wife since she did not sign for the debt. They can continue calling since you can't prove you paid it, but they can't force payment through a judgement. Tell them next time they call that it has been paid and that they are past the statue and not to call again.
