I have an account with Capital One that was turned over to Weltman, Weinberg and Reis. I asked for a DV letter about 45 days ago and still have not received one. Weltman keeps calling and I keep telling them that until I receive the DV letter, I am not talking to them.

If you have sent a DV letter timely it is a violation of the FDC

I have dealt with them. First save all messages, they likely violate the FDCPA. In my experience the messages they leave violate the FDCPA in that they provide no meaningful disclosure. The above post is correct as well, if they call again before providing the validation that's another violation. In our case, they did provide validation and it was very thorough. We took a preemptive strike and sent notice to them of our election of arbitration per the cardmember agreement...This is supposed to effectively waive both the OC's rights and our rights to have the matter heard in court.

Can you explain a little more to me on the election of arbitration. I really just want to pay what we owe. Even a settlement if possible. I know we owe the card not very positive on the balance though. Thank you

Weltman, Weinberg & Reis are bottom feeders and as stated before will violate every law on the books. Don't have a conversation with them until they answer you VOD. Stick to your guns. If you chose to settle with them then just make sure your offer is reasonable but low. Make sure you have proper documentation before you pay!

Just recieved a letter from WWR that says "a lawsuit is being filed against you" along with what looks like an official complaint however there is NO case number...regardless, this is for a $5400 debt with Chase..I have 2 questions.
1. Has anyone here actually been sued by WWR?
2. Has anyone here settled with WWR? And if so, at what % ??

Mid-January I received a summons from Cuyahoga County Court of Common Pleas for a Chase Bank debt represented by WWR. I have been working with a debt settlement company (Lloyd Ward & Associates) for over a year and Chase/WWR refuse to have any communication with them. An attorney at Lloyd Ward told me exactly how to reply to the summons --essentially a DV, so we'll see what happens.
Just FYI, I am VERY Happy with Lloyd Ward and Associates to date. I read a lot of Bad Things about DS companies and this hasn't been an issue with me as of yet. Yes, I did pay a large monthly fee up-front but so far they settled an almost $13K Citi account for $3,200.00 and have been working with BOA and another creditor.
Also, there were a few months (Nov, Dec, Jan '11) that I was unable to make my agreed monthly payment to the trust account --No problem; they just said it would tack on another few months.

We wanted to go to court just so we had that opportunity to talk to them and twice we took days off work and twice they didnt show. But of course they dont get in trouble for not showing as the average person would. Just work with them and dont be late because they will not hesitate to tell you theyll take you to court and get a judgement from you and regardless of your family situation they dont care they will threaten jail time too. My husband travels for his work and I almost felt like I had to sign for him because he is gone 2-3 weeks at a time and they threatened finding him and putting him in jail because of his debt to them. I ended up paying them without my husbands signature because they freaked me out! Good luck to you, we have been blessed enough to only have to deal with them for less than a year and were done. We dont have any intentions of ever screwing up again so hopefully it stays that way.

I just turned WWR over to a debt setlement company...they were demanding at least 980 which I dont have. The debt is over 8,000. WE are paying debt settlement 270 per mont which we can afford..no up front fees and checked out with BBB..I dont know if they will come and sue me, but at least Im trying.
