Sounds like it is too late for arbitration if the lawsuit has already been filed. Have you received a summons?
Pay for delete is not technically illegal....however a lot of creditors including Capitol One refuses to do so based on company policy.

Havent recieved anything from them as of yet. The person I talked to on the phone said he filed the suit on the 11th and i should recieve a notice in the next 2 weeks. And who should I send the letter too Capitol One or the law firm?

The law firm and I believe also the court if you receive summons. You must also answer summons.

cap One dropped their arbitration agreement last January - but if you defaulted prior to January 2010 you can probably still choose that. Read up on how you do it, it is a letter that you send the electing the arbitration. Can't be sure, but I think there were some posts about people electing it when they went to court even. but you will have to read up.
