Hello my question is this, How do I go about requesting arbitration? I recently tried to get ahold of Captiol One to settle a debt I had from an old account, they transfered me to a law firm that said they just filed a suit against me. When I got angry and broke ties with them my card had a balance of $1250 so I called to ask if I payed the $1250 could we settle and could I get a deletion letter that I heard of and the attorney told me No sorry thast illegal and he will stop the lawsuit if I pay $1400. I am very sceptical as to not even receiving a call or letter from these people that any of this is true. After reading the forums I saw the post about arbitration and was wondering if this was a good option or not?

The law firm and I believe also the court if you receive summons. You must also answer summons.

cap One dropped their arbitration agreement last January - but if you defaulted prior to January 2010 you can probably still choose that. Read up on how you do it, it is a letter that you send the electing the arbitration. Can't be sure, but I think there were some posts about people electing it when they went to court even. but you will have to read up.
