Sued before receipt of demand of payment

being that you live in Texas, you have the best laws in the country on your side. However, a debt validation letter is not going to help you now--once they file suit, youre still entitled to the same proof, but now you have to go through the courts and motion for discovery. They can sue without sending you any notice first. If we knew more about the situation we could help you prepare better. For example, who is the debt collector/plaintiff? It is also possible that the debt they are suing over is past the statute of limitations. You are probably better not posting info here in the open about this, as some debt collectors actually visit this site and read up on these threads. If you like, you can email me.
