I live in Texas, Being sued by an attorney in Texas in the facts of the case it states that on or about April 13, 2010, Plaintiff sent a demand letter and despite delivery of demand letter on further payments have been made. I never received a demand letter at any time the only letter I received was the citation registered mail from the court saying I must answer so I did. That was Oct. 09, 2010, I also sent a request for validation on Oct. 12, 2010 no response to date. The Bench Trial is Set for Feb. 11, 2011. Can you I be sued with no validation or demand letter? this is a junk debt buyer!
Any input would be great.

hiya--

being that you live in Texas, you have the best laws in the country on your side. However, a debt validation letter is not going to help you now--once they file suit, youre still entitled to the same proof, but now you have to go through the courts and motion for discovery. They can sue without sending you any notice first. If we knew more about the situation we could help you prepare better. For example, who is the debt collector/plaintiff? It is also possible that the debt they are suing over is past the statute of limitations. You are probably better not posting info here in the open about this, as some debt collectors actually visit this site and read up on these threads. If you like, you can email me. My email is the same as my user name here, at yahoo. Or, if you prefer, you can join this forum, and as a member you can send private messages to other members. It is free to join and you dont need to sign up for debt counseling if you do not want to. Please get back to me, I would be happy to help!
