Cashnet USA is a legal lender and you will have to pay them according to your contract. Because you've gone into default they will not offer the EPP. Process server's never call you to tell you to call someone. They serve papers. The process server will not file papers that would be up to the collection agency, and Eric Hurst would serve the papers. Have you tried to call Cashnet to find out if they turned your account over to collection and if so to whom? I would start there first. If Check Resolutions happens to be the collector for Cashnet, they would have your mailing address and would of already sent you a request for payment in the mail. As long as you've not moved since your original application.

well buzette check resoultions is not licensed period.cashnet has been selling debts to these places more and more.also there is more than one cashnet.paydayloan yes also goes by cashnet500,or just cashnet.there are a couple of threads about CHECK RESOLUTIONS,and cashnet in those claims to know nothing about this collector.i would not pay them anything without something in writing first.as far as a worst case scenario?never heard of this illegal bunch doing anything but call and threaten.as buzzette stated.no legal process server would call in advance,or negotiate for a creditor.first sign of a scam.first determine if this was cashnet usa,or just cashnet.then file a police report as again no process server would ever call in advance and give the details this person did.then call cashnet.i'll wager that either they sold it,or will claim to know nothing.then this "process server"is nothing of the kind and should be reported as well.

The claim that you still owe $450 is ridiculous and would not hold up. It would cost them the $450 to hassle with the suit. Most of all, the loan was probably illegal to start with and they have no legal means to collect. I would send them a cease and desist letter and ignore them unless you are actually served. Verify any summons papers through the court to make sure they are legitimate. [/SIZE]

You should never admit to owing a debt to a voice on the phone, whether you actually owe a debt is irrelevant, the point is, you NEVER actually know who is on the other end of a telephone, so never ever discuss a debt on the telephone, you have rights under the FDCPA and should exercise them.
My advice to you is educate yourself on the FDCPA, you can google it and research your rights. I would encourage you to file a complaint against them with the FTC and your state attorney general, please.

If you educate yourself on the FDCPA you will learn that you can have that judgment vacated, if what you are saying is true.

I also received a call from "Eric Hurst". Apparently he is moving up in the world. He has graduated from process server to attorney. He is apparently working for Copeland Law Office. Another interesting note... the number they left shows up in one entry that I found on google from E-Check Recovery LLC
