we got a call at my husbands job today regarding a pdl with SSM . He was not there at the time and they asked for his manager, who was also absent and then for HR which they were transfered but HR didtnt get the call. The number on caller display was for National credit adjusters. They are licensed in TN but SSM is not actually not licensed anywhere that i can find. My question is i saw on the laws regarding collectors that if when we ask for it to be verified they can come up with some kind of bill for the amount that they can continue to call you etc. Surely they cant be allowed to try collections for a company that isnt legal to trade in the first place. I will take it all the way to court if they push it i am not going pay for an illegal loan. They had all but $25 back and when i wrote and told them that i was withdrawing ACH etc but i would pay the $25 they wrote back said the debt had been sold and they couldnt help.
I have a C and D letter ready and a debt verification letter to send certified when we get something in writing but how much information are they required to give if and when the amount is verified?
thanks this forum is a godsend

Yes, you can send a debt validation letter to them. Rather, you should send a validation letter via certified mail. You can get more information on debt validation from the following page:

If the payday loan company is illegal in your state and your husband does owe money to them, then you're husband is only required to pay the principal amount and nothing else.
