I received a "special civil part summons" in the mail today from the NJ Civil Court on behalf of Goldman & Warshaw for an alleged debt they say I owe. I called Goldman & Warshaw and spoke with "Tracey", who already knew my name before I said it. She asked me to verify my identy by giving her my SS#, however, I did not do this. This is the FIRST correspondence I have received from GW. She told me she would be happy to send me out the Debt Validation, certified mail. Shouldn't this be something that GW should send PRIOR to sueing you? When I asked when I would receive the Debt Validation, she could not give me an answer, except that I would receive it. She told me not to answer the summons within the 35 day allotment, to wait for the debt validation and then we would "go from there". So, my question is, am I being sued or not? My guess is I will never receive the debt validation. Should I request the debt validation from them in writing? I've gone through this in the past with other debt collectors, and NEVER rec'd the debt validations. Thoughts?


You were served a summons and the law firm said not to answer it. Oh lordy do NOT listen to them. If you were served you have to answer it or you will get an automatic judgement against you. Sounds very fishy if they told you not to answer. They want a judgement against you, so that sounds like they do not have the documentation to win in court. Answer the summons with denials or I dont how enough info to answer. and then in court ask for discovery where they have to prove the have the documentation and are legally able to collect.

first check with your court clerk to see if the case is real.if so follow the advice above.sounds fishy to me though,but as stated above me do not trust the law office at all.check with your court clerk to be sure.

I did call the court. The woman there was very nice and told me to answer the summons within the 35 days. I will do that. I just don't understand how a law firm can issue a summons without EVER having tried to collect the said debt . Now I have to WASTE my time by going to court, and it's a $15 filing fee to answer the summons, for something that doesn't even belong to me.

if this truly isn't yours then go to court.fight it and get this dismissed with prejudice(meaning it can't be sued on again by anybody).the 15.00 will be worth it to see the bottomfeeder leave without a dime.
