You were served a summons and the law firm said not to answer it. Oh lordy do NOT listen to them. If you were served you have to answer it or you will get an automatic judgement against you. Sounds very fishy if they told you not to answer. They want a judgement against you, so that sounds like they do not have the documentation to win in court. Answer the summons with denials or I dont how enough info to answer. and then in court ask for discovery where they have to prove the have the documentation and are legally able to collect.

I did call the court. The woman there was very nice and told me to answer the summons within the 35 days. I will do that. I just don't understand how a law firm can issue a summons without EVER having tried to collect the said debt . Now I have to WASTE my time by going to court, and it's a $15 filing fee to answer the summons, for something that doesn't even belong to me.

if this truly isn't yours then go to court.fight it and get this dismissed with prejudice(meaning it can't be sued on again by anybody).the 15.00 will be worth it to see the bottomfeeder leave without a dime.
