 I need information on the firm of Lukehart & Associates PC, Westminster, Co . I receive a call from one of their assocates name Goldie and she left me this phone number to return her call, 1-855-606-3375, which I did call on May 12, 2011 and spoke with Ms. Goldie and we set up a payment plan for me to pay my debt off that I have with Bank of America and a payment schedule was set up; that date and I try to phone Ms Goldie @ Lukehart & Associates the operator said that the number I was calling was not in service, so I look up on line and found another number and call it and the automatic voice mail after I enter the ext number that was given to me by Ms Goldie, and was told to leave meassage however the extention I enter was not the same extention that was repeated by to me; then I saw difference statements made by other people on line when I pulled up the site of Lukehart & Associates about fraulent action going on with this firm and a red flag came up and I need to know is the money that's being subtracting from my account is going to settle my debt with Bank of America or I am been scammed. Please let me know as I am receiving unemploment and that is my only source of income at this time and I would very like to pay this bill off as soon as possilbe but I don't have money to give away and it' not going to the offset my debt. Thank You.

If this was their first contact with you, they were required, under FDCPA 809(a), to have sent you a formal, written collection ("dunning") notice within 5-days thereafter, advising you of your rights and how to request debt validation under FDCPA 809(b). If you never received dunning notice from them, that is a sure sign that they are not operating under the FDCPA.
If you have an address for them, I would immediately send them a written DV letter, forcing them to cease collection until they have provided you debt validation under FDCPA 809(b). As part of that process, they are legally required to contact the OC and provide you verification that the OC affirms the debt, and its amount. That puts scammers on the spot. If they provide validation without following the requirements of FDCPA 809(b), they are digging a hole.

I would also suggest you contact your state bar administration regarding the status if any party representing attorney status. They are the source of that information, as well as possible sanctions against this party.
