hi guys -- I am trying to settle an amex acct with them -- I confirmed with amex that they sold the account to them. I called them today -- 12/31 to settle -- on a 5500 balance they offered 1200 -- 22 percent so I took it -- but.... I don't have a fax so I told them to email ---
they couldnt I went as far as to set up an online fax service -- when I called them back to get the letter the mgr told me the settlement was voided --

any recent experience with these guys -- I settled another amex with nationwide credit recently and they are going ok --- I also see the credits being applied online to my amex acct. and yes, I have a settlement letter from them which they emailed to me .

so, after trying to settle with these guys and them not waiting for my fax number and then cancelling the deal when the mgr was upset I couldnt find a fax machine in 10 min, they start calling my mom today --

I already validated my phone number with them on the phone and gave them my contact info. this hot headed mgr over there thinks he can do whatever he wants to get in touch with me. well guess what -- last week was good, now it is not since I settled something else before the 12/31 deadline --

can he still call my relatives and neighbors after I validate my contact number? -- they told her it was an impt bus matter and she said she had nothing to do with this and he insisted she write down the phone number and reference number -- if she said I dont' want anything to do with it -- it should stop right there -- I was willing to settle with him last week -- he decided to cancel the deal not me.

today they called my neighbor. They told her that their manager was rude to me over the phone last week and they wanted to apologize. I already verified my contact info with them when I spoke with them last week as well as 2 previous times in november and december.

my neighbor emailed me the number as well as the conversation and phone number.

what do I do to report these people? --

Report? You need to report them, but at this point you really need to go to www.naca.net, find yourself a consumer attorney in your area and sue them ASAP for this harassment. You need to contact everyone that has told you they got calls from these clowns about you, and ask them to make written statements of what took place on those calls. This harassment is disgusting!

As for reporting, you need to file complaints with the FTC, your state attorney generals office, and AMEX--if AMEX is using these morons to third-party collect their debt, they need to know what this company is doing with their accounts. If they sold the account to First Source, thats a different story. This is a massive violation of the FDCPA. But in cases like these, those complaints usually do not add up to much. Thats why I said you need to get an attorney and sue them. Many of those attorneys offer free initial consultation, and you at least need to see what kind of a case this makes. I have helped people win over debt collectors in court before for less of a violation than this.
