I have one more year in my chapter 13 five year payment plan and was thinking in paying it off in five to six months so I can get an early dismissal maybe by end of year. My question is can I do this or is the trustee going to ask for more money since I can pay more?

Also I took out a credit card with $300 limit to help reestablish my credit is this going to hurt me in dismissal of Chapter 13.

Thanks

1. If you were an above median income filer your commitment period is 60 months. If your commitment period is 60 months you cannot get out in less time unless you pay 100% of all allowed claims.

2. If you were a below median income filer your commitment period was 36 months. Since you are beyond 36 months, if your commitment period was 36 months you can pay off the Plan early without paying 100% of all allowed claims (unless your Plan called for such payment.)

3. The minor post petition credit card debt is not going to effect anything.

Des.
