I have spoken to a lawyer regarding chapter 7.
I am not scared that with my husband income wil be too much. All debt is in my name. PD loans, personal loans, credit cards and medical bills plus IRS payments. All in my name including a car loan which I want to keep and of course the IRS.
We file seperate taxes. Now both of us split living expenses. He does not help me with my bills. Nothing and he pays his own.
If he does not help me with my bills and all living expenses are split will this help my case even if he makes too much?

If what you are asking is will they allow you to file without his income being taken into account, the answer is no. He is part of your household. You probably will be looking at chapter 13

If you do a chapter 13, he will be paying more than half of the bills. Does he earn more than you?? It so, hopefully his % of the split of bills is higher than yours.
