What state do you live in now?? Was it advance america you borrowed from? They are a legal lender and could end up suing you civilly.

A DV is a demand letter that forces them to provide proof that you in fact owe them the debt. If they cannot provide you with proof, like a signed prom note or agreement, they cannot collect. It protects you from scammers.

Great thinking and action that if any collector wants payment, NEVER send them a check with your account info on it! Instead, great job with being smart enough to offer a money order instead. And should you ever send a money order payment to a collector, send it certified mail!

There is not much is Fairmont but maybe wilted corn and soybeans. And the Law office of Larry Roach is located in the Fairlawn / Copley area. He is known for pulling that kind of stuff. They do operate a few dumbie businesses as well. I will check this out. But if it is him, he does have a track record of taking legal action!

Anyways, as Soaplady pointed out, they cannot sue you if you are in Florida and they are New York. Unless, they hire an attorney that is licensed in Florida. Just be aware that is can be done. Not to scare you, I have been dealing with a collection agency from out west and after a number of failed attempts to try to get me to pay, they did hire an attorney in my state and a civil suit was file. It has been going on now for about 5.5 years.
I understand your concerns of not knowing where to send any infomation such as letter requesting them to validate the debt. That is why I looked them up and posted the addresses for you.
To narrow it down, do you have a the city that this Vantage Point is located in? Or what is the number that this guy is calling you from... if you know.
Be aware that this guy is required to provide youn various information about the alledged debt such as the name of the original creditor, account numbers, charge-off date (if it applies) his name and his contact info such as aaddress... or the address of the company he is working for.
If you have the address to this Vantage Point in New York, I would recommend you send a letter to them. Make sure you send it certified mail and state in your letter that you are disputing the alleged debt. You can also attach a s simple cease & desist letter telling them to no longer contact you in any way shape or form other than what is allowed by law... like that they are complying and legal notices. As Soaplady stated, you can tell this guy this over the phone until you are blue in the face, but you need everything in writing.
It can be frustrating with all the calls, but don't pay anything just as of yet.

The reason is that in my situation we have found that the collector has obtained a list of everyone in my state with the same or similar name and has attempted to file a civil suit against them for the same debt. This is why my three suits lenghty and messy. Thankfully, my 4 person legal team and I have been contacting each of them and the courts in the counties they reside in to make them aware of what is going on. Hopefully we'll keep a lot of people with the same name from paying on a bogus account they never had. Just be aware of the greedy and unethical tactics they can and do employ!
