I am currently paying around $1500 in fees biweekly. It is getting impossible to pay my necessary bills. I have considered working with a credit counseling program. I am nervous to close my bank account, but I really need to settle my debts. I appreciate any advice.

Whitney- Great Plains is a tribal lender. Search this forum for letter and evoke eft from them and if you've paid your principal tell them you want a paid in full letter. If it's not paid tell them you'll finish paying principal only in money orders. I just finished up with them and just received my paid in full letter from them.

I spoke to a credit counselor from a company called Debt Management Credit Counseling Corp, and he suggested that I close my account. They offer to work with the lenders and sum up your total balances of all your loans and divide it into 12 monthly payments at 0% APR. It sounds too good to be true in my opinion. I currently have paid Great Plains $1592.14 of a $3000 loan, and my account says my balance is $2815.13. I have paid Uncle Warbucks $1275 of a $1300 loan, and my balance is still $1430.

Don't close bank account all of a sudden. See, you have to pay the principal amount along with the interest rate to the legal lenders. Just pay the principal amount to the illegal lenders. You said you had considered credit counseling session, but didn't mention the suggestion you got from the session.
However, you can talk to the lenders who are legal for an extended time. Or, you can request for a reduced amount mentioning your financial hardship.

Yeah I agree. I just don't see any way around the illegal lenders continuing to try to debit my checking account. I already have another account where I could send my direct deposit for my paychecks. I'm wondering if I should just close my current BOA checking account, and notify the legal lenders about my other account and workout payment arrangements. Can anyone please advise? I'm trying to act on these things as soon as possible, so I can start taking back control of my finances.

Whitney- See, they are not
Whitney- See, they are not supposed to tell you that close the account. I think there is a miss understanding. If you are considering debt settlement, then you should stop making further payments. Also, you have to stop incurring further debts from the same lenders.
As per my opinion, ask all the illegal lenders to send you the "paid in full letter" since you have already paid the principal amount. If they deny and continue withdrawing money, revoke ACH authorization.
For the legal lender, you are liable to pay the money along with the interest.
If you are unable to make payment, then you can consider settlement. I hope this will help.

I also didn't believe that a debt counseling company should give me that advice, so I have decided not to do business with them. Plus the agent keeps calling me non-stop and trying to get me to act quickly. I have decided to handle matters myself. I have closed the account because too many illegal lenders have access to it, and they have not been willing to accept my request to revoke ACH authorization.
UPDATE: I have sent the ACH revoke authorization letter to Speedy Cash. They are a legal lender, but were unable to provide a payment extension or payment arrangement over the phone. I was told over the phone that the collections department would only be able to work out payment arrangements. I will give an update once this matter has been resolved.

I actually paid $860 on this current loan (borrowed $1300 on 5/3/17), and I paid a total of $2359 on a loan (borrowed $800 on 11/04/16). I wanted to apply the overpayment of the first loan towards this amount. So the current loan, I owe $440. The old loan, I overpaid $1559. Subtract that from the current amount owed, and they owe me a refund of $1119.

I apologize if the numbers were not accurate from the original post. When I stopped payment at my bank, this prevented a payment of $330 that was already pending to come out of my account. This increased my total amount balance owed. This amount also doesn't include foreign transaction fees debited from my account, which I do not have access to the amount since I closed my account.

Not really sure how to proceed. I interpret this as my final chance till they send the account to collections. I've filed complaints with the Tennessee Department of Financial Institutions. I have paid $1119 above the principal.

They are an illegal payday loan lender. They can't do anything. Relax!
