Hey Shirley - ironically enough, I FINALLY got a copy of my Equifax report (after 40 minutes on the phone trying to prove that I am ME) and I checked it out. NCO has some bogus hit on my account, they are trying to collect for that Cingular account! The one I am sending the nasty letter for!! I am gonna slam these guys. Ugh!!

I'd be interested in knowing your story, because I'm about to take a couple of junk debt buyers to court. LVNV for one.

I believe that if a person honestly owes a debt to a company, and is contacted by a 3rd party collector, one should try to settle. --But-- as to "junk debt" buyers (ie., debt purchasers) no one morally, nor legally owes them anything. You will not help your credit rating by paying them, in fact it could be made worse.

You are very right. In Texas we have various laws which idiot debt collectors in other parts of the country are probably unaware of.

In Texas, even if they somehow get a judgment against you:
You have a $30,000 personal asset exemption ($60,000 family). This especially effective if you are unemployed or self employed. You could be considered "judgment proof".

They cannot take your house or car (except if this is what the money was owed on).

They have 30 days to answer a request for validation.

And many others, which also applies to original creditors (not just 3rd party collectors). In short, if Texas residents demand their rights, collectors stand to get next to nothing to satisfy judgments.

The worst company I have ever worked for was an auto finance company called Triad Financial. If anyone has loans through them or Roadloans (same company) I'm sorry. They are a terrible company to deal with. The employees are bitter because they are treated badly...and the debtors get the brunt of it.

In Tennessee there is also debtors law, if you make under a certain amount, they can't collect. By what I've read however, if you are sued, garnishment is much left up to the judge, so it's best to show up if sued there. There are also certain exemptions under the law in Tennessee I believe. I used to live there quite some time ago.

They cannot garnish your wages but they can place a lien against your bank account. It is said that once your wages are deposited into your account they are no longer considered wages therefore leinable. Please tell me if you have heard differently?

I'm glad to see others standing up for their rights...and Hey Settle up...I bet your collector. Go collect a life. Shirley..keep doing what your doing. And to any and all that have been victimized, you have Rights...Use Them. Good Luck to All.

Your right about that I live in SouthCarolina and its the same.Matter in fact the lady told me at the court office they do not do dept courts no more.As she told me "A waste of time and tax payers money".The Judges in our county just do not want to here it anymore.Plus she added that most CA broken the law in some way or another.

Wish those laws in TX applied in PA & VA.... Wolpoff& Abramson/Great Seneca Financial is actually the worst! It took my husband & I 3 years to get them to remove an identity theft account. That is even after we sent multiple copies of the police reports proving that he did not live in VA at the time of the incident!

My best friend, a man, had a tearful panic attack because of the stress brought on by this company. He was laid off of two of his three jobs (security), and fell behind. It has gotten so that he can no longer use his phone. I and others are organizing a class action suit and youtube documentary; you would not BELIEVE the laws this "lawyer" and his sister company, Atlantic Credit & Finance, break. I can't IMAGINE what they're thinking.
I went into debt due to illness brought on by disabilities suffered during the war. I lost my apartment, and eventually my job. I was homeless for two weeks. I'm now working through my illness with the VA, and going to school to retrain for a job I can actually do with my physical limitations. I'm constantly on the verge of getting kicked out of my present living situation because of their calls, and then they'll never get their money! So, their behavior is just... idiotic, really! They are shooting themselves in the foot!
I had enough. I have NO money, but went to talk to a lawyer. The constant phone calls, the attempts to get me to borrow money from my family, the harassing language, the calls as early as 6:58am, and as late as 10:20pm, the failure to answer a request for validation of debt letter, and the refusal to stop calling this house and harassing people who aren't even involved; all are going to cost the company MORE money than my debt was even WORTH! Soooo..., how stupid can you be? According to my lawyer, Frye could lose his license over this kind of stuff! Are they nuts or something?
I'm getting a suit together in California, but there are people in so many other states being harassed by these guys. My friend, also a vet, does student films (doing documentaries about vets after the war). We're putting a documentary together for youtube to inform people and the public about what is going on with these guys. They're literally affecting the mental and physical health of hardworking people who have just fallen on hard times.

You need to get an attorney to defend you as an individual. A class action lawsuit will only put money into the pockets of the attorneys. It amazes me that the laws allow class action suits as the people who are hurt receive almost nothing while the attorneys make a fortune. This is wrong! It is so wrong that it makes me feel that the hard working people of this country have become impliments of personal gain for those who are in a fortunate situation. It is so disgusting to me that I have trouble retaining my last meal.
Send them a debt validation letter and find yourself a good attorney that specializes in FDCPA violations. Try NACA.org for a start.

I am so upset I am livid that you are a Vet who has been treated this way and all the Vets who are going through this I know this is a Credit forum and I am off topic .. But we all need to stand up for this bad treament of our Vets ... Enough is Enough .. If a class action suits get some one attention great
