they are just collectors using desperate attempts to collect money. i use to work for allied cash advance and had to collect debts. they only call your family members before they call u as a way to embarrass you. they figure u don't want your family to know so they tell them anyway. when u took out a loan, u signed a confidentiality agreement that they are now violating. don't be manipulated or fooled. pay when u can, but don't lose sleep over this.

Thanks for the filing complaint info! I continue to receive calls regarding my neighbor's financial problems. This time it was Legal Mediation that called and actually harassed me regarding my unwillingness to contact my neighbor regarding this issue. File a complaint already!

This is a total scam. The only way that you can go to jail for not paying a debt is if you promised to do so in the property settlement agreement of a divorce. debt collectors will say ANYTHING to get you to send them money. They will say things like, "You are going to Jail" or "Doesn't your family care about you enough to give you the money to pay off this debt". It's ridiculous, but it happens. Don't let these people get you down, just mention a hiring a lawyer to represent you in this matter and I'm sure they'll get off your back.
It costs about $2,000.00 to go after someone for a debt that you believe they owe you, so they aren't going to spend that kind of money to actually try to collect from you most likely. That's why they resort to harassment. Good Luck All!!

They called my sister looking for me, his name was Jack, then I called back and talked to his supervisor and I told him I tried making arrangements to pay this and they wouldn't do it, so whatever and then he said that's what your statement will be then, "WHATEVER". These people are so irritating. And yes it scares me because its a payday loan, but I had another payday loan place actually take me to court on a matter of the same effect but they couldn't do anything because I am under poverty level.

Please be mindful that debts are civil matters not criminal. You are not going to be arrested. Legal Mediation Practices appear to have a very bad history of making unlawful threats of arrest and incarceration. Depending on what state you live in you may be able to record their phone call without their knowledge and use it as evidence to submit to your state Attorney General's office as well as the Federal Trade Commission.

They have been contacting me in error regarding someone I don't know and when I try to tell them I am not that person (which is a male) nor do I know that person, they treat me as if I'm an idiot. I'm pissed because I have no way to stop these idiots from calling my cell phone number for the person they are trying to contact. I would love to get an address for these folks and write to whoever's in charge to insist that they check their facts, update their system, and stop calling my number! Oh, and let's not forget that they really need to learn how to talk to people! The persons I have to are a Mr. Davis (he was polite and apologetic) and a Tom Law (the biggest ---hole I have encountered)!

As I understand it, once they make the threat of taking legal action they have 30 days to make good on this threat or you can sue for fdcpa violations; making a threat they have no intention of or are unable to follow through on.

The thing that kills me, and you make the same point JC, if all CA's would deal above the board without having to resort to the constant illegal chicanery, they would probably increase the amounts they actually collect. Hate to say a good amount of CA's think it is easier to resort to the stereotypical CA foolishness and end up breaking the law. And Il-Legal Mediation Mal-Practice seems to lead the pack of crooked CA's when it comes to violating the FDCPA.

I called her and told her this and she looked up info about it and found this forum and called me back and said just ignore it its a scam. Well I called back the guy to get my number off their lists and when I got ahold of Jim King I said he called me earlier about my sister and he said, who are you and who is your sister. I said im none of your concern and my sisters name was _____ ______. He said these exact words, if your none of my concern than get the f*** off my phone! AND HUNG UP! I live in mass and payday loans are prohibited.....therefore the paday loan company does not have lending authority and the provisions of the contract are not witin the law...it is not legally binding...thanks to a previous post. Well, magovn, if they are threatening to "garnish your wages", they first have to sue you, win that lawsuit, then get an order to garnish your wages in order to do so. It's not something that is going to happen overnight.
If they are threatening to exercise some sort of "wage assignment" in order to get money out of your paycheck, all you need do is send them a written statement revoking said "wage assignment."
Do a little searching on this site regarding garnishment and wage assignment, you will find much more detailed explanations regarding them.

CA's do not have standing to file suit but if the debt is significant, there is the possibility that they would retain an attorney licensed to practice law in your state to file. Was this a PDL or a credit card debt? What state do you live in? When was the last time you made a payment on the account?

Well, my husband got the same call threatening jail the same day, said they had him on camera and everything, which was not true because I did the loan online through Discount Advances. Since they threatened jail time the same day, we sent them over $500 Money gram. They said they would send us exoneration papers in 5 days. This was about a month ago and still no paperwork. I see now that many people have had this same problem and we were scammed out of $500 dollars.

I got a call from these idiots today. I believe is about a payday loan that i didn't even take out! the woman asks my name and tells me "Get a piece of paper and pen!" I said no, what is this about? and she tells me "Just hire yourself a Lawyer then" and hangs up. I'm completely put back but this, and call and asked for a supervisor, and was told there are no supervisors and she is the only person that i can talk to, well I lost me cool and said colorful things and she hung up, but what kind of business is this? and how can we stop this sort of thing?

Got a call from Sharon Jackson back in August and she informed me that "a case was trying to file charges against me in my county at 12 (noon) and I could get myself exaunerated if I paid her the money before then" I told her I didnt have it and she said she couldnt help me as she was just giving me a courtesy call letting me know this was happening.
I freaked out and called my husband, parents, and the courthouse (my cousin is the SA). Was told by everyone not to believe it. A few weeks later I started getting calls from Mr. Brian Thomas from the Fraud division (*insert eye roll*) but I let the voicemail get it. Then Mr. Hanner started calling (same day) over and over so I would pick up my cell and hang up. That must have made poor Mr. Hanner mad as he left on my voicemail (when I finally let the phone pick it up) that I had the mentality of a 3yr old, I was unresponsible, and I had a gay ringtone. Yeah. SO I filed AGAIN on them with the Fl AG, the IL AG, and with the FTC. They have taken to calling me 3 times in a row in a 5 min. period now. Sometimes they leave message sometimes not. They are annoying and wont see a DIME!! I will pay back to the people I owe, Magic Cash for those in Illinois but I am looking into filing a complaint against them since I found out they actually HIRED Legal mediation practice to do this for them! YUCK!

My guess is they never sent you the initial dunning letter? The one they are required by law to send within five days of the inital contract? That's another fdcpa violation.
I might also suggest saving the VM where you were advised you had the mentality of a 3 year-old. Pop that out and play it for the attorney you hire when you get tired of LMP's crap and decide to sue them for FDCPA violations. Also, record any and all calls you have with these clowns, even more evidence you can use to sue them. Make sure to check your state laws as to whether you are a 1-party or 2-party state when it comes to recording calls, though.
Sounds like you are handling them pretty good, though. Thanks for filing those complaints with the authorities, every little bit helps towards getting these @$$-clowns shut down.

Yes, Heather In CA, you should send them a debt validation letter. By law you should receive a letter from them within 5 days of the initial telephone contact; however, I have yet to hear from anyone on this site that does.
Mrs. Andrews was the first person I ever had communication with at LMP, so if your call goes anything like mine did with her, then be prepared fro anything. I might suggest recording the phone call when you make it. I checked and CA (if that is the state you live in) is a tow-party state. Meaning both participants in the phone call have to know about and consent to being recorded. I would point out to Mrs Andrews, if she refuses, that if she isn't going to be breaking the laws with threats of arrest, bad check writing, fraud, etc. then she shouldn't object to being recorded.
I would also keep a recording of that message she left on your VM.
Because that's more than likely what will happen when you do call her: she will threaten you with arrest, that you have been passing bad checks, committing fraud, pretty much anything she can think of to get you to pay then and there. Don't fall for it.
I might recommend reading through all the threads on this site regarding Il-Legal Mediation Mal-Practice before you do call them.

PA is a 2 party state. DV the CA and at the bottom state that a

I did file with everyone I could and will continue as needed. They wont get me to send them a dime and I'll gladly tell the judge that if it goes to court (and will also gladly play all messages left to me by them). I'd rather just pay the loan people but now that this yahoo's have the paperwork (and just so you guys know, most of the info Sharon Jackson had on me is wrong, like peoples phone numbers, my vehicle, etc) I guess I'll be waiting until it goes to court, then I'll work something out with the loan company in mediation.

They don't have to come right out and tell you that you will go to jail, all they have to do is imply it so that the "least sophisticated consumer" would reasonably feel they would.
Add to that, the fact they never send any written documentation within the 5 days required by law (or at least, I have never read any post where someone has received this required letter from Il-Legal Mediation Mal-Practice), and their threatening phone calls and messages, and they are known heavy violators of the FDCPA.
Good that Ms. Jackson is now being a little more professional on her calls; however, I would not pay these yahoos a dime until they validate this alleged debt of yours.

True you owe money but it is to the original creditor. Call the original creditor and make a settlement. You can also file a lawsuit against this company with the Federal Trade Commission and possibly recieve $1000.00 if you win. Google search FTC for yourself.
