Hello,

I have done some searches on this forum in regards to a company called A S and Associates.
THey are saying that I will be brought up on charges if I do not pay in full my payday loan.
From reading acouple of posts it seems these are scare tatics. My question is that do I have right? And can I place a complaint or charges on harassment.
I want to pay the loan off but need to make payment arrangements and they are telling me I must work though them only and will not give me any contact information on the Payday loan company. They will not let me dispute any of the additional charges, they said I must pay it in full then dispute with the loan company.
Any advise is greatly appricated.

You have as many rights as a consumer as the collector. From the many posts, I wouldn't be too scared of these tactics because they are all used to scare you and make you pay them as soon as possible. I would send them a debt validation letter to validate the debt they are trying to collect and make sure it's not a scam. I would then try to work out a payment plan and stop all the stupid fees they might charge because you have not paid the loan off. But you must communicate with them and give them the amounts you agree to pay per whatever cycle you agree on.

Thank you for your responses. I actually contacted a lawyer and they have agreed to go after AS and Assoicates. They said I had rights and they were breaking the law with their tatics on collecting a debt. My lawyer was able to get the address of AS and Associates. Here it is: AS & Assoc, 16350 Park Ten Pl. #100-1, Houston, TX 77084
I saw on some post that they couldn't find the address. This forum is great and gave tons in information. My lawyer even stated that she goes into this forum to get helpful informtion on collectors.

First of all know you rights. fdcpa laws are made for debt collectors. If you find them violating these laws, you can definitely bring charge against them. And when it comes to collection agency, debt validation is the first step. You must ask for validation. Send you request through CMRRR. See for more details-

This company scammed a friend of mine out of 586.00 on a 250.00 loan. She borrowed the money from me after they threatened to arrest her at our job. The man's name is Inspector Weinburger. Then he refused to send her a copy of her paid debt because the credit card she used was mine. Only after I threatened him witha lawsuit did he send her a copy.Do not send them a dime. I believe she said her loan was through VIP Cash.

Well I'm pursuing a law suit against them. They threaten me with the police and refused to give me a debt validation. They want to play games with me then I can play also. I have no problem payng what I owe I just want documentation on what I owe and not to be threaten with the police, both of which are against the law for them to do. The person I talked to was Investagator Stevens.

They called me yesterday, and threatened me with arrest. I got scared and tried to find ways to come up with $800 for a $390 loan. I called a family member that told me that in Texas you can not be criminally prosecuted for this.

I called the Chief Inspector David Bernstein back, and told him I had just left from the police dept. to turn myself in. Bernstein then says he has to go he has another call.

I call him later to make arrangements & told him that the officer, told me that I could not be criminally prosecuted for this. He began asking me to make some kind of payment. I offered to pay a small amount, and he said no he could not accept it and hung up.

Welcome to the forums.

If you owe anything to the company, you must have the details in writing first. The company must not scare you or threaten you with legal actions until the documents have been verified by you. Request the company for the details and then make your payment arrangements.

After the debt has been proven, you can send a letter of your payment arrangement. If they accept, it will be good for you. If they don't, you will always have the proof that you tried to pay the debt but the company has been unwilling to work with you. Even if the matter is taken to the court, you can prove your part of the story with these written evidences. Make sure that you do your correspondences in writing through certified mail with return receipt requested.

I was also treaten with the police but was told it was illegal for them to do that. That really got me boiling..thats why I reported them to the FTC and contacted an attorney. I am in the process of suing them for harresment. I have never in my life sued anyone or company. I would always let things be but this was just too much. I was terrified that I would be arrested. I would be scared to answer my door or phone even at work I was worried that I would be arrested and then fired. After all that stress that was done to me I am fighting back...I don't care if I get no money in the end I just want them to know that they can't push me around and break the a law.

I came home from work and found a message for someone who does not or has never lived here. The message stated to please call if they had the wrong number and let them know. I called with Cathy Bishop, who called and left the message and she started harrassing me and I am not even the one she is searching for. She told me she got the number from Directory Assistance. She asked if my name was the same as the one they are searching for and I said yes. She yelled at me saying , "So this is the wrong number, huh?" and I said yes that I don't even know the people they were searching for. She acted as if she didn't believe me! I told her to please don't call here again and leave a message, she hung up on me.

I called back and asked to speak with someone to complain about a worker and this person was just as rude as Cathy. She started yelling "So we have the wrong number?"..over and over again. I asked her for corporates address and/or phone number and she hung up one me.

These people are the rudest people I have ever dealt with and all I was doing was returning a call to let them know they had the wrong number. I didn't have to do that but I thought I could help them and have them move on to some other search.

God help the people they are searching for, they are extremely rude and unprofessional.

If they are pressing you for having the similar name, ask them to verify the ssn# they have in their system. This way, they will realize that they are getting in touch with the wrong person.

Since you are sure that you don't owe them anything, you can send a cease and desist letter forcing them to stop making any contacts with you. If they do, it will result violations of the fdcpa law and you will have a fair chance of filing a case against them.

I asked for corporates address and they hang up on me. I would certainly send a letter if I knew the address, because someone needs to know that people shouldn't be treated like this especially since I was only trying to help them as to continue their search somewhere else.

I tried to look up the address using a search engine but no luck. My last name is the same as the people they are searching for but the first names are not.

You know what is lacking in our society since we continuously use our phones for communication for customer service and similar situations is the companies are not taking responsibility in their Reps attitudes. Never do we get anymore, I am sorry to have bothered you, it was our mistake, I'm sorry for the inconvience this has caused. We have no other recourse but to put up with it and allow these reps to hang up on us. Calling back and speaking with a supervisor is a waste of time also. I am beginning to think that I should be "monitoring" all of my calls when I speak with a Rep, i.e. taping the call...then I have something concrete to send these corporate offices when I write to complain. Then if they do care how a customer is being treated then they will do something about it.

He calle dme yesterday and did the exact same thing to me threatening me with the police and i did the same as everyone else i panicked just to find out he is a liar and can tell you that legally over the phone.

If anyone gets a call from these idiots listen to me! DO NOT give them a dime! Get something in writing....I've dealt with these jerks and they are NASTY! I fought back and filed complaints and asked for validation on the debt and havent heard a word from them in over a year! Dont fall for these scams from AS&Associates!
