Refund letter from Quikpayday!
I received an email from Quikpayday today. The letter they attached stated that they are sending me a refund and marking the loan paid in full. Yeah!! I can pay off the dentist office lol.
They sent it as a pdf attachment, but here is the text of it:

We are in receipt of your recent email alleging that we have violated Virginia law. As you are aware, we disclose numerous times on our website, through our application process and in each of our loan agreements, that our relationship is governed by Ohio law. We have no facility, offices or employees in the state of Virginia, thus we have no "presence" in Virginia and do not fall under their jurisdiction for licensing. At all times during operation, Quik Payday has been licensed, governed by and compliant with the laws of the state of Utah. You, as a consumer, consented to the factthat our contractual relationship would be governed by Utah law. Furthermore, you were informed that if you did not want our transaction to be governed by Utah law that you should seek a loan elsewhere. Obviously, you have become accustom to our high level of customer satisfaction and it is our desire to resolve this matter as quickly and amicably as possible. Enclosed with this letter is a check for $880 to settle this matter. Your endorsement of the check shall constitute full and complete release of any and all claims you may have against Quik Payday arising from any loan or finance charge you paid to Quik Payday. It leaves one pdl that hasn't been forgiven, but they dropped the balance owed to $400 (from $930) so I'm trying to decide what I want to do about that. I'm probably the only one here that has borrowed from them since it is a military-only lender.

I don't know why some companies will forgive loans, some will refund, etc for one person, but not for others. Maybe it's based on how many times a person borrowed, so how much they overpaid?? There are some people that are still waiting for a pdl to forgive loans, even after following the same steps we have used.

That could be true, however when you took out the loan with our company you signed a Utah loan agreement, so the loan terms are under Utah Law.

We loaned $300 to you, so there was a pay back for $360. You took out two extensions which cost $60 each, the first one was due on 12/9/05 and paid, the second was due on 12/27 but was returned to us so that became a $80 dollar payment. Then your loan was due on 1/6/06 and that was also returned making that payment $380. So at that point you would have had a balance of $460. There was a $230 payment on 1/17 that was returned to us, so your balance became $480. On 2/4 we had a payment of $120 pay, then on 2/18, and 3/4 we also had payments of $120 pay. At that point your balance was $120, and we had 3 more returned payments which we did not charge you return fees on. Your balance currently stands at $120 and that is scheduled for 5/12. Our website and loan agreement let our customers know that our loans are governed by Utah law and that if you are not in agreement with Utah terms and regulation that it would be best to seek a lender in your state of residence. Is there a standard letter that any of you have used to contact QuikPayday? If so, would someone mind sharing the format of the letter. I had several loans with them but am paid off now. However, after finding this site I am now realizing that Arkansas has some laws regarding payday loans that I was not aware of, and their interest rate was too high and Arkansas also does not allow rollovers (assuming I am reading the citation correctly). You can also notify your intentions of reporting the matter to the local AG's office as well as the FTC and the BBB. Many of us here have used the legal means of getting the money back. I hope you will also be able to get the refund back.

Get the latest info about payday loan business from the Pennsylvania Attorney General office.
As you already have a loan from one of the lenders, it will be better paying it off. The lenders make negative approaches on the consumers who default on their accounts. You will not like to invite any hassles for the later stage.
