Contact the court clerk to see if there is a court date. What credit card had the summons served? My summons had the date filed and court date and where to appear. You can contact an attorney and have him look over the summons and advise you. Make sure the attorney is reputable. Mine I think has screwed me over along with HSBC's attorney. If there is a court date, be sure to appear so the credit card company doesn't get a default judgement.

I guess this is not the legal summon from any court. Legal summons must have a court date of hearing. It seems to be me that the credit card company is trying to scare you by sending fake legal papers to you.
If this is a legal paper, a copy of it must be with the court also. Visit the clerk of the local county and look out for the related records.
If you have due credit card bills, I will recommend you to talk to the company and work out arrangements with them. After the bills are paid, it will be reported in your file in a positive way.

I've been in debt for a long time, and was working with a credit counseling service until 2 years ago. The service paid off the small balances, which left 4 really big balances. I decided to stop the program, because at the time I was in real bad shape financially and couldn't even make THOSE payments. I was harrassed by MANY collection agencies, and now I am dealing with a couple different companies, trying to get them to work with me on clearing up my debt. This summons has freaked me out, because I had just started to deal with this card (it's from Household Bank).

I received maybe 3 or 4 bills from them, and had tried to contact them to make payment arrangements, but they were extremely hard to negotiate with. So I ended up putting them on the back burner while I dealt with some of the other accounts I had.

T&C got copies of the payments and sent them to the attorney. He has deducted the T&C payments from the balance owed. HSBC is the worst credit card company around. I have been fighting their marking on both mine and hubby credit report. They are showing charge off and the cards have been in consolidtion. Watch you back with these crooks.

HSBC has done something illegal but not posting your payments towards the accounts. By law, they have tried to hurt your credit negatively. Its better that they have deducted the total balance owed with T&C. But you have a case here. Your accounts should not be reported as charged off. They should be reported as current in your file.

After carefully going over my summons, a couple of things popped
After carefully going over my summons, a couple of things popped out at me.
1) There is no appearance date, and
2) The summons is a copy; there are no original signatures or stamps anywhere on it.
My question now is...does this copy serve as a valid summons? Doesn't it need to be an original? Could this be a scare tactic, as indicated by CurlyCarl above?

Check with the clerk of the local county and see if there are any legal records in your name. If there aren't any, you will be confirmed about the company using false means.

And then he left. And like I said, all of the papers are photocopies. So I'll check with the court to see if it's on file.

Tammy, have you requested for the results of the investigation done by credit bureau? Tell them that the information put in your file is not correct because you have proof against it. Send them copies explaining your part. Requesting the results also come under your federal rights.
When you are sure that the credit bureau is wrongly reporting in your file, you can consult an attorney and file a case against the bureau or HSBC. Your suggestion!!

Okay, I'm dealing with HSBC with my debt settlement company. They haven't contacted them yet and should do in the next few weeks. It seems odd to me that they would serve you at work in the first place. Is this even allowed? If they decide to get sue happy with me, I do not want to get served at work. I would think they would have you sign something, showing that you received the summons in the first place. This whole situation just seems odd to me. When hubby got served by the mortgage company, he was served at home and he did have to sign. This showed that he received the summons. I don't think there was an actual court date set but it said we had twenty eight days to respond to the court and to their attorney. We also received certified letters from the clerk of courts. The situation has been taken care of and we have made arrangments with the mortgage company. We've received other letters since then but we mailed a certified letter to the clerk of courts and to the mortgage company's attorney today. It stated the arrangments made with the mortgage company and papers showing the arrangments between the two parties. The mortgage company is also contacting their attorney and the clerk of courts to let them know the situation is settled and we don't have to go to court. No judgements will show up on either of our reports. Now, HSBC does seem sue happy this month, especially with a balance as low as Tammy's. It sounds like she did get screwed over, sorry Tammy. I would research the matter further, if I were you. It would seem odd that a judge would rule in favor of HSBC when you have been making regular payments to HSBC through a debt consolidation company. I know they will try anything because that is how they operate. I am keeping records of all the calls that I received at home and at work from them. I had three phone calls at work and each time I stated that I could no longer receive phone calls at work. I am taking other steps to make sure that this doesn't happen again per advice of my debt counselor. They don't leave messages on my cell phone but it has caller id. I purchased a new home phone with caller id this weekend. You would think there would be a limit on how much an original creditor could call in one day. I would call the clerk of courts to verify this summons. It just seems odd to me but I don't know much about these things.
