My bank acct.
Date: Fri, 05/12/2006 - 07:37
I called my settlement company and enrolled.
Now, my quesiton is: Since I always paid by check..do you think they will dig for my acct number on my check and illegal debit money from it? They can't do that can they? I mean, because I was never enrolled in automatic debit with them, I wrote them a check monthly.
Or do you think they will give my bank acct number off my check to the collection agency?
also...
when they threaten with seizing bank accts...they are looking for savings aren't they? Since I have no savings, they can't seize my reg bank acct can they? They would have to have get judgement first, and since I am enrolled in settlement company, that would probably be thrown out! I am just getting my ducks in a row and writing my own guide....

Hi ljclark1
The credit card company cannot take out money from your account after you have enrolled in the settlement program. The consultant is responsible to do the negotiations with your credit companies and arrange a payment plan with them.
However, you must monitor your bank account closely. You cannot trust any company if they intend to do mischievous activity. Make your bank supervisor aware of this situation so that he does not allow any debit in your checking account.

I understand what you are saying...but what I am concerned with is this: (and I tend to go way out there with the what if's)
What if this third party collecter has my previous checks I paid to Sears and decides they want to order checks with my acct number and forge my name or something? Or what if they just call the bank and act like me and sign me up for autmatic debit once a month.... or do you think Sears gave them my checking acct information off the checks I paid them with? I am just curious.
Surely that would be to darn risky for even Sears to attempt pulling on someone...what is your opinions? I think I have just gone crazy and speaking out of my head with dementia or something.

Linda, don't put yourself into so much of serious thinking. Trust me, nothing like that is permissible by law. Besides, if the CA tries to do something like this and Sears allow them doing so, it will be a serious violation of the law and the companies will come under legal problems.
Take some rest and keep such thoughts away from you. They are causing you disturbance.
here is what I dreamed up last night....
I have 3 accts with wfnnb. State, Roamans and Lane Bryant. Ok...two are in the program and one I still get to keep under 500.00 balance. I still pay current on one of them and I have even ordered items from them and received them since their nasty CA got involved.
What if they take my check I am paying the one card and rearrange some numbers by fruad to try to get their money? I know that is major illegal, but should I rule out that thought? or could they actually try something like that?

John,
I have three different department store cc's with the SAME bank. I am only paying on one card monthly and that is the one I was allowed to keep.
I think that is kind of weird, I am sending payment to the one acct to that bank, however they are demanding their money from me and see my check come in once a month for the card I am paying on.
I was just thinking "what if" they wanted to really rake me and my bank acct over the coals, they see my acct number everyday. I had a dream I went to write a check to pay a bill and the CA's had took my check.
It is all getting to me....the settlement company says the CA's can get some people to buckle to their threats.
I am armed and ready....

Hi Linda,
Filing a case at court is pretty costly and besides it takes lots of time and patience. The company won't run to the court for a single person even if they have a leg to stand on. This is just my personal take.
They are seeing your payments each month. Even if they take the matter to the court, the judge will see your account getting paid with what you can afford. You would have definitely sent more money towards all the accounts if your financial situation permitted. The judge will rule out in your favor. Relax!!
