Why are our members getting refunds?

I just read several threads of our members getting refunds? How does this work? Is there a letter that can be sent? I know for a fact that I have paid far more than my home state allows and the kicker is I am still sending payments to pay off the loan. Suggestions anyone?


I received finsfan13's form letter. I cut a and pasted my states law into it showing that they in fact charged me triple digit interest when in fact they are breaking the law since they are not to cap 30%! Wow, so, I am going to give this a try. I need to research exactly how much I paid into each loan and try to calculate best I can. Lets see what happens.

Keeping to this discussion, I will be glad to interlink the blog of. It has suggestions on how to deal with the lenders of the different states. It will be worth a shot.

Some lenders are not easy to deal with. You have to be persistent with them. But it's for sure that if you have paid them with excessive charges, they must refund the extra amount. Use the state laws defining the permissible interest charges and fees. Seek legal advice if it helps!

Thank you for introducing the link you posted. It lets me look at this in a whole new light and I will be honest with you I am really upset with the amount of money I have been putting into paying off these loans. To think at one time I made them a priority over my car payment and everything else I had to pay. Good grief what was I thinking! I will call T&C tomorrow. I don't think I need to pay them anymore money and I want them pulled out of my program. It's bad enough I paid triple digit interest over the course of a few months surely paying over what I borrowed and now I am still paying them through T&C? I am so glad I learned that they actually are in the wrong according to my state laws. This will take some homework to figure out each one and what I paid including what T&C paid but I really think I am going to pull them out of my program and send them this letter. I am really upset about this. One payday loan company even made me fax them a blank check then tried to cash it when I defaulted, that is a hugh no-no in my state. I guess I am ready for the rumble now. I just needed to get over the scared and into the mad :twisted: Thank you so much everyone! This site is the best thing that has happen to me!

Hi katl8ee---have you signed up as member of this site (its FREE) and received the free debt counseling? Are you having problems with any particular payday loan companies. One thing about this site is everyone has had much experience in dealing with them on all levels. They might be able to give you some pointers if you have some questions.

Yes I did sign up and spoke with someone about my bills. The company I have a payday loan with the counselors don't deal with. I was just wondering what this letter said and if I could use it? Since then I talked to someone in the Penna Banking and they tell me there is nothing I can do but pay the loan and make a complaint with the attorney generals office. So I don't need the letter anyway.

What state do you live in katl8ee? I don't know a whole lot about the individual state loans regarding pdl's but I have learned that they are illegal in some states, legal in others and some of them operate illegally in those states that have banned them. I believe there is a thread on here somewhere about the different laws. Give it a look see and post a new thread asking a question about it and I am sure one of the very wise members can assist you with your inquiry.

is it true that HSBC will sue you - I owe them $358.00 and I am going to make a payment next week - I wrote them a letter - but now I don't know I think Iwill call them this weekend
