My husband is a full time student--no salary. After 9/11 we got into serious CC problems when I lost my job. We have been working with a debt settlement co. that has paid off many other accounts so far. The last ones left are large balances. We have had one judgement against us. The CC's are in his name; one of our bank accounts has been frozen. Another court date for a judgement is pending. Our cars (also in his name) are still being financed by the auto loan people, and we do ot own a home. My question is what if anything can be taken from us in a judgement and what time frame are we expecting?

Make sure that you appear in front of the judge in the court date. Explain your financial situation very clearly so that he can work out payment arrangements for you. If you can make the payments regularly, creditors won't take your property away from you. In most cases, creditors can't take your assets for recovering credit card debts. There had been a chance if it would have been for secured debts.

What I have been reading in prior posts about judgements and everything, I feel I got screwed by our attorney and HSBC attorney. Should I go ahead and have the attorney keep the court date and go to court and provide all proof without a lawyer and tell him what both attorneys stated about HSBC being able to put a lein on property with me not working? What is your honest opinion? I am so confused now.

I was surprised when you said last time that HSBC will recover the amount by putting a lien for unsecured debts. This happens only while recovering secured debts.

Well, I will suggest you to visit the nearest law enforcement office in your area and discuss this matter. It's worth giving a try. Let me know the outcome of your discussion.
